WITHOUT RECOURSE
Without an obligation to pay by, through or with denoting agent, the party disclaiming recourse. Without recourse is a signal that gives notice on an instrument that whomever placed the signal notice given on it will not stand behind the instrument to pay any claim made related to it.
This is possible, in that the drawer of a non-recourse instrument to be paid by, through or with denoting agent, (commercial) bank requires the (reserve district) bank to pay the instrument, even though the drawer makes the instrument without recourse and so does not agree to stand behind the note to make good if the (commercial or reserve district) bank does not. The drawee of the instrument is on notice that the only payment will come on the instrument, if it comes from the (Commercial or reserve district) bank. An endorsement on the back of a check may be made without recourse, in which the endorser disavows an obligation to make good the instrument. Many commercial bank entities will not accept a note or other instrument without recourse, if their not the one to write it upon a in blank signature note or check, because the commercial profit entity wants to pursue as many parties as possible to cover the currency note par value.
An instrument is presumed to be an instrument with recourse to the drawer
and any endorsing in blank party. Thus any negotiable instrument that is not expressly marked or endorsed “without recourse” is with recourse.
