the respondent owns the residence outright or regardless of whether the alleged victim is on the lease or title; requiring the respondent to attend counseling; and awarding the petition- er physical custody of any minor children of the relationship and prohibiting the respondent from having parenting time. In fact, Orders of Protection are often used as a strategic measure against the respondent in an existing divorce or custody pro- ceeding to gain the upper hand in a custody battle. If the minor children are included as protected parties in the Order of Pro- tection, it may take months or even years in some instances for the respondent to get his or her parenting time restored.
Perhaps the most devastating consequence an Order of Pro- tection has on Chicago Police Officers is, once an Emergency or Plenary Order of Protection is granted, the respondent offi- cer will be immediately ordered to surrender all firearms, their FOID card and their CCL to the State Police. This will result in the Chicago Police Officer facing definite and certain conse- quences, including being stripped of their badge and gun, be- ing found to be unfit for duty and being put on no-pay status or being separated from the Department completely. As stated above, this can be compounded by the fact that the Emergency Order, whether based on factual or fictitious allegations, will remain in effect until the petitioner withdraws the petition or until after a full hearing on the merits has occurred, thereby potentially lengthening the time an officer is subject to no-pay status and separation.
That is why it is critical that, immediately upon learning of an alleged Order of Protection being granted against them, a police officer should consult with and obtain competent repre- sentation to eliminate or minimize the long-lasting and poten- tially permanent effects an Order of Protection can have on a Chicago Police Officer’s career and family.
