SCHEDULE 1 Planning Obligations
1 ALLOCATION WITHIN THE DEVELOPMENT PLAN
1.1 The Promoter will at its own expense use reasonable and commercially sensible endeavours to promote the Property for Allocation through the emerging Stockport Local Plan and Greater Manchester Spatial Framework and may (where it considers it appropriate to do so) make representations at the appropriate times to the core strategy and subsequent development plan documents.
1.2 The Promoter will promptly supply the Owner with copies of all reports documents and plans submitted in relation to the development plan and keep the Owner reasonably regularly informed as to progress with the Allocation proposals.
1.3 The Owner shall promptly take all such reasonable steps to support and assist the Promoter to obtain an Allocation.
1.4 The Owner will not object nor procure nor support any objection to the Promoter’s proposals for Allocation of the Property.
2 PROMOTER’S OBLIGATIONS
2.1 The Promoter will at its own expense use its reasonable endeavours to:
2.1.1 obtain a Relevant Planning Permission through the due planning process; and
2.1.2 submit a Planning Application which is consistent with the Objectives within six (6) months of the date of this Agreement, or, if later one (1) month after obtaining the approval from the Owner pursuant to paragraph 2.2 below unless the Parties agree to the Planning Application being submitted at a later date (it being acknowledged that the Promoter may submit a number of Planning Applications) and agrees to notify the Owner in writing once the Planning Application has been submitted.
2.2 Prior to the date of submission of the Planning Application, the Promoter shall submit the draft Planning Application to the Owner for approval and the Owner shall notify the Promoter in writing within five (5) Working Days after receiving the draft Planning Application whether the Owner approves the draft Planning Application (such approval not to be unreasonably withheld or delayed). The Owner shall give reasons if it does not approve the draft Planning Application.
2.3 If the Owner does not notify the Promoter in writing of its reasons for refusal within five (5) Working Days after receiving the draft Planning Application then the draft will have been deemed to have been approved.
