1. Plaintiff is a New York resident, residing in Westchester County.
2. Defendant is a New York Resident, residing in New York County.
3. Plaintiff and defendant were married in Kings County on March 15, 1969, and have three minor children.
4. Plaintiff does not wish to bring this lawsuit, but she understands that a lawsuit is a necessary precondition to the granting of a divorce by this Court.
5. Plaintiff, acting by and through her attorney, but principally on the economic advice of her brother, Arthur Rebell; and defendant, acting by and through a partner in his law firm, who was at first entirely acquiescent when it came to the economics of the proposed arrangements, had negotiated terms of a proposed Separation Agreement that dealt with, among other things, custody, visitation rights, rights in and to the marital property, and support payments.
