Election Reminder - Friday, September 4, 2009
Before any application for a Foreign Worker can be submitted to
the Human Resources and Skills Development Canada (HRSDC) the employer must prove that he tried to  nd a Canadian to  ll the position  rst.
On Friday, September 4, 2009, Ontario Horsemen will be electing 11 Directors (6 Owners/5 Trainers) for a new three-year term effective at the Annual General Meeting in September 2009.
It is mandatory for employers to advertise the job on the internet Job Bank site located at www.jobbank.gc.ca for at least two weeks. However,  rst the employer must register their business free of charge on the site. Employers will need to submit their Business Number to register and may be asked to fax some proof of their business.
Nominations close at noon, Friday, July 3, 2009.
Quali cations:
• Must be a member in good standing, who is currently, or was during the preceding 12 months (6 months for Trainer), licensed as such by the Ontario Racing Commission and has started a thoroughbred race horse in the current or prior year or applied for membership in the H.B.P.A. of Ontario.
• Must be 18 years or older
• Must be a resident of Ontario in the preceding year
• Must not work or serve on a board for a racing association, racetrack operator, horse breeding association or be a member of a racing commission.

During the two week period if a Canadian applies for the position and they meet the employers requirements then the employer should hire them. Employers must maintain a record (name and phone number) of anyone that answers their ad and reasons why the applicant did not meet the requirements of the job.

At the end of the two week period the employer must print off any and all ads and submit these along with the HRSDC Labour Market Opinion application available at the HBPA of ce.
Additional candidates may be nominated by a petition form signed by at least  fteen H.B.P.A. members. (Blank petition forms ar available at HBPA of ces at Fort Erie and Woodbine). Deadline for  ling with either the Fort Erie/Woodbine Track of ces or the Head Of ce is noon, Friday, July 3, 2009.
After assessing the application the HRSDC can ask the employer for further information such as:
An of cial job offer letter with the following stated: job title, duties, hours per week, wages (stated as an hourly rate) and a statement declaring that as the employer they will take off all appropriate taxes & deductions.
Ballots are expected to be mailed around July 31, 2009.
If the employer has employed other Foreign Workers within the past twelve months, the employer must provide evidence that have taken the appropriate taxes and deductions and the status of the Foreign Workers employment with them.
2009 is an election year for the Board of Directors of the Ontario HBPA. All Owners and Trainers and current HBPA Members can stay informed and be eligible to vote by providing the HBPA with your name, address and email address (if applicable).
In addition, if the trainer wants the HBPA to be able to call on their behalf in regards to their Foreign Worker application they need to  ll out the section entitled ‘Third Party Information’.
This is necessary for us to be able to provide you with up to the minute facts on what is happening with the HBPA of Ontario, Woodbine and Fort Erie, and all North American Racetracks.

Whip Pilot Program
Your WSIB account covers the salary of workers that are injured while working for you.
The Jockeys’ Bene t Association of Canada, the HBPA of Ontario, the Ontario Racing Commission and Woodbine Entertainment Group are jointly introducing a pilot program with respect to use of the whip.
Did you know that you can request WSIB Optional Insurance to bene t you if you are injured at work?
Information on the timing and details of the pilot program will be released on Friday, May 29 which also includes an opportunity for questions and discussion.
This way you will receive a salary from WSIB while you are unable to work. The premium for this additional insurance is based upon your gross earnings from the previous year. If this is the  rst year that you are a trainer it will be based upon the average earnings for this position.

Trainer & Assistant Trainer Testing 2009
Applications for Trainer and Assistant Trainer testing are available at the track of ce. PLEASE NOTE: All applications must be submitted three weeks prior to the test dates. Only complete applications will be accepted.
