 Infringement offences
WorkSafe inspectors can issue an infringement notice if you commit certain offences.
WorkSafe will continue to undertake compliance and enforcement action for all laws it administers.
However from 31 July 2021, specific provisions under the Occupational Health and Safety Act 2004 (OHS Act) and Occupational Health and Safety Regulations 2017 (OHS Regulations) will be prescribed as infringement offences.
The prescribed infringement offences apply across all industries already regulated by the OHS Act, including construction, working with asbestos, major hazard facilities, hazardous substances, mining and quarries.
If you commit any of the following offences under the OHS Act or OHS Regulations, WorkSafe inspectors can issue an infringement notice.
Please see below a list of some of the industry Infringeable offences under OHS Regulations.
