 3. the Insured shall be considered his own insurer for 15% (fifteen percent) in respect of 1 and 3 above and 25% (twenty five percent) in respect of 2.4 and shall bear a rateable portion of the loss accordingly;
4. one or more stacks/piles or groups of stacks/piles collectively not exceeding R500 000 (five hundred thousand rand) in value and situated less than 100 (one hundred) meters from each other shall be deemed to constitute one fire risk.
Crude fodder, Silo bags and Tobacco
In respect of the insurance by this Section it is a condition precedent to liability of the Company that:
1. an area of at least 10 (ten) meters wide shall be kept free from all combustible materials and vegetation around every stack/pile or group of stacks/piles constituting one fire risk;
2. an area of at least 5 (five) meters wide shall be kept free from all combustible materials and vegetation around every building containing crude fodder.
One or more stacks/piles or groups of stacks/piles collectively not exceeding R300 000 (three hundred thousand rand) in value and situated less than 100 (one hundred) meters from each other shall be deemed to constitute one fire risk.
Storage of crops (seed) in silo bags
It is a condition precedent to liability of the Company that cover applicable to crop (seed) stored in silo bags at the premises of the Insured stated in the Schedule will strictly be subject to compliance with the manufacturers specifications including maintenance of the silo bags as prescribed by the manufacturer/supplier.
Storage of tobacco
1. The Company shall not be liable for damage caused by water unless the roof of the building in which such water damage occurred sustained physical and visible damage by any of the perils insured and that water penetrated the building;
PROVIDED THAT:
the Company shall be liable for destruction of or damage to property caused by flooding which for the purposes hereof shall mean:
1. the flooding or diversion of water out of normal watercourses or from natural or man-made watercourses;
2. the flow of or accumulation of water on the ground except the flow or accumulation of water from water pipes, taps, valves, gutters or gutter downpipes.
2. Notwithstanding the above it is further warranted that:
2.1 no fodder of any kind shall be stored in the buildings which are utilised for the processing or storing of leaf tobacco;
2.2 all tobacco waste is swept up and removed from the sorting or storing barns daily;
2.3 no drying of tobacco is done by means of flue curing;
2.4 the Insured shall in writing keep record of quantities of tobacco which are on his/her premises daily namely:
2.4.1 Tobacco in kilns;
2.4.2 Tobacco in the process of being processed;
2.4.3 Processed tobacco already baled and still in stock; and 2.4.4 Tobacco already marketed.
Such records must be kept separately in safe custody away from the tobacco sheds and kilns and must be available in the event of fire damage or loss to determine the damage.
2.5 the temperatures in the tobacco stacks and humidity around the tobacco stacks from the time the stacks are packed and until it is unloaded from the stacks for further processing and/or treatment thereof be monitored at least twice a week and that proper written record of each stack shall be kept separately and that the Company may at any time be entitled to examine the Insured’s records in respect of stack temperature and humidity reading.
