3.1
The Reinsured grants such coverage for strikes and/or riots and/or civil commotions, as an extension to a fire and allied perils property damage insurance policy:
3.1.1 only to a selected number of its clients, which have been carefully and reasonably evaluated to present commercially reasonable risks based upon Reinsured’s application of sound underwriting practices and policy, and
3.1.2 only when such coverage is subject to commercially reasonable terms and conditions in light of the exposure of such risk, including but not limited to an additional premium (commensurate to the exposure), an appropriate deductible (in percent of the loss with a minimum) and a limit of liability expressed (in percent of the total sum insured per risk or affected location, whichever is the lesser, and a maximum for all claims losses per insurance policy).
the cover, as granted by this Endorsement, is subject to an annual aggregate limit of ZAR100,000,000 or USD 10,000,000 or GBP 5,000,000 for 100% applicable to claims or losses directly or indirectly occasioned by, happening through or in consequence of any strikes and/or riots and/or civil commotions (SRCC).
For the purpose of this Endorsement, physical loss or damage resulting from any strikes, riots and civil commotions shall mean loss of or damage to any building or other property insured directly caused by:
3.3.1 any act committed in the course of any strikes, riots and civil commotions resulting in the disturbance of the public peace by any person taking part together with others in such disturbance; or
3.3.2 any wilful act of any striker or locked-out worker done in furtherance of a strike or in resistance to a lock-out whether or not such act is committed in the course of a disturbance of the public peace; or
3.3.3 any act of any lawfully constituted Authority for the purpose of suppressing or minimizing the consequences of any strikes, riots and civil commotions, or for the purpose of preventing any such act as is referred to in 3.3.1 or 3.3.2 above or minimizing the consequences thereof.
However, it is agreed that the above definition relating to a and/or b and/or c of this Endorsement does not waive or derogate in whatsoever manner the WAR AND TERRORISM EXCLUSION ENDORSEMENT contained in this reinsurance. It is thus understood and agreed that any loss and/or damage arising from looting, pillage, felony, theft, burglary, malicious damage, vandalism or any comparable activity, if they occur in parallel or in connection with any strikes and/or riots and/or civil commotions, remain excluded as per the WAR AND TERRORISM EXCLUSION ENDORSEMENT.

Annexure A – Treaty Exclusions

1.4 The act of any lawfully established authority in controlling, preventing, suppressing or in any way dealing with any occurrence referred to in 1.1, 1.2 or 1.3;
are excluded from protection of this Contract.
Notwithstanding any provision of this Contract including any exclusion, exception or extension or other provision not included herein, this Contract does not cover loss or damage to property or expense of whatsoever nature directly or indirectly caused by, arising out of or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any sequence to the loss, damage or expense.
For the purpose of section B an act of terrorism includes, without limitation, the use of violence or force or the threat thereof whether as an act harmful to human life or not, by any person or group of persons, whether acting alone or on behalf of or in connection with any organization or Government or any other person or body of persons, committed for political, religious, personal or ideological reasons or purposes including any act committed with the intention to influence any Government or for the purposes of inspiring fear in the public or any section thereof.
If the Reinsurer alleges that, by reason of section A or B of this exclusion loss or damage is not covered by this Contract, the burden of proving the contrary shall rest on the Reinsured.
Strikes, Riots, Civil Commotions Endorsement (Only applicable to Corporate business and for countries outside of Sub-Saharan African)
Not regarding anything stated in the WAR AND TERRORISM EXCLUSION ENDORSEMENT contained in this reinsurance, it is herewith agreed that the Reinsurers shall indemnify the Reinsured against direct physical loss of or damage to the interests reinsured caused by or arising from strikes and/or riots and/or civil commotions, including fire damage following strikes, and/or riots and/or civil commotions provided:
