 Annexure A – Treaty Exclusions
 If the Reinsurers allege that by reason of this Endorsement any loss, damage, cost or expense is not covered by this reinsurance, the burden of proving the contrary shall be upon the Reinsured.
In the event any portion of this Endorsement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
This Endorsement forms an integral part of and is governed by the terms and conditions of the reinsurance between the Parties, to the extent not otherwise stipulated to the contrary.
4. War and Terrorism Exclusion Endorsement (Only applicable to Corporate business and for countries outside of Sub-Saharan African)
Notwithstanding any provision to the contrary within this reinsurance or any endorsement thereto it is agreed that this reinsurance excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing concurrently or in any other sequence to the loss:
4.1 war, or state of war, whether declared or not, invasion, acts of foreign enemies, hostilities or warlike operations , and/or
4.2 civil war, rebellion, revolution, insurrection, mutiny, riot, strike, military or popular rising, and/or
4.3 civil commotion assuming the proportions of or amounting to a popular rising, and/or
4.4 martial law, state of siege or state of urgency or any events or causes which determine the proclamation or maintenance of martial law or state of siege or leading to a change of government or head of state, and/or
4.5 Final or provisional expropriation by confiscation, requisition ordered by any public authority, and/or
4.6 any act intending to overthrow or influence the government, local authorities or part of them with force, by means of fear, with violence or the threat thereof, and/or
4.7 any act of terrorism, and/or
4.8 looting, pillage, felony, theft, burglary, malicious damage, vandalism or any comparable activity if they occur in parallel or in connection with any act referred to in point 1 to 7 of this endorsement
This endorsement also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to 1 to 8 above.
For the purpose of this endorsement an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological, ethnic or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.
If the Reinsurers allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this reinsurance the burden of proving the contrary shall be upon the Reinsured.
In the event any portion of this endorsement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
5. Computer Loss General Exclusion
General Exclusion applicable to this Contract insuring damage to property or the consequences of damage to property or any liability.
This Contract does not cover:
5.1 loss or destruction of or damage to any property whatsoever (including a computer) or an loss or expense whatsoever resulting or arising therefrom;
5.2 any legal liability of whatsoever nature;
5.3 any consequential loss;
directly or indirectly caused by or contributed to by or consisting of or arising from the incapacity or failure of any computer, correctly or at all.
