FAMILY MEDICAL LEAVE ACT
The Family and Medical Leave Act (FMLA) allows up to 12 weeks of unpaid, job protected leave
for speciic family emergencies such as serious illness or the birth or adoption of a child. FMLA
eligible employees are eligible for up to 26 weeks of FMLA leave in a 12-month period for the care
of a service member who is injured in the line of duty. This leave is only available to the service
member’s spouse, son, daughter, parent, or next of kin. “Next of kin” is deined as the nearest
blood relative of the service member.
You are eligible for FMLA leave when you work at a location with 50 or more employees within a
75-mile radius, have been employed with the Company for at least 12 months and have worked a
minimum of 1,250 hours in the prior 12-month period. Employees are eligible for FMLA if they meet
the criteria listed above.
UNIFORMED SERVICES EMPLOYMENT AND REEMPLOYMENT RIGHTS ACT
OF 1994 (USERRA)
USERRA protects the job rights of individuals who voluntarily or involuntarily leave employment
positions to undertake military service or certain types of service in the National Disaster Medical
System. USERRA also prohibits employers from discriminating against past and present members of
the uniformed services, and applicants to the uniformed services.
If you leave your job to perform military service, you have the right to elect to continue your
existing employer-based health plan coverage for you and your dependents for up to 24 months
while in the military. Even if you don’t elect to continue coverage during your military service,
you have the right to be reinstated in your employer’s health plan when you are reemployed,
generally without any waiting periods or exclusions (e.g., preexisting condition exclusions) except
for service-connected illnesses or injuries. For assistance in iling a complaint, or for any other
