Fury As Court Rules 11 year old ‘Consented' To Sex With 28 year old
A French court is facing heavy back- lash from chil- dren's rights groups after decid- ing an 11 year old girl consented to sex with a 28-year- old man.
The man was charged with rape but prosecutors say there's no vio- lence or evidence to justify the vio- lence of rape.
Prosecutors deemed the child had engaged in a consensual " sexu- al relationship" with the man, lead- ing to immediate backlash from chil- dren's rights groups.
France correspon- dent Catherine Field says the man has now been
charged with sexu- al abuse of a minor instead.
"The law does not account for rape for someone under 15, if there is no evidence of vio- lence then it is just sexual offences," she told Mike Hosking.
The case centred on allegations the man lured the girl from a park in the northern Paris suburb of Montmagny to his nearby home in April.
The Local news outlet reported the man allegedly raped her. The girl's family said she was "paral- ysed" by fear and "unable to defend herself".
But in a decision that's prompted anger, prosecutors decided "there was no violence, no constraint, no threat, and no sur- prise" on the part of the man to justi- fy the charge of rape.
Rights group Le Voix de
l'Enfant said in a statement: "The question of con- sent or its absence should never even be asked when it comes to rape vic- tims who are minors".
There are now calls for French legislators to intro- duce a legal age under which sexu- al consent cannot be presumed.
