Man Whose Domino's Pizza Delivery Never Showed Awarded $1200

A NSW man whose Domino's Pizza order never showed up at his home has been awarded more than $1200 after suing the fast food chain for breach of contract.
Corrimal lawyer Tim Driscoll ordered three pizzas, two garlic breads and two 1.25L Cokes from the Domino's web- site on Anzac Day last year, The Daily Telegraph reports.
When they had not arrived an hour later he phoned his local store at Fairy Meadows, where the manager apologised saying they had been "inundated" with orders and a full refund would be provided.
But the refund also failed to arrive and after a year
of being "fobbed off" Mr Driscoll decided to take the drastic step of pursu- ing legal action.
"They kept saying they were looking into it but after 12 months of fob- bing me off with 'we'll get back to you', I thought I
had to bring it to a head," he said.
The personal injury and workers compensation specialist sued Domino's for breach of contract, initially demanding $9000 "to teach them a lesson".
Yesterday the matter was heard in court, where Mr Driscoll had a win after Domino's failed to attend and to acknowledge the judg- ment.
The chain has been ordered to pay Mr Driscoll $1203.27 to cover his legal fees and the $37.35 order.
Domino's later accused him of wasting the court's time and said they will appeal the judgement.
Mr Driscoll now plans to take further court action to force the firm to pay and has asked the Australian Competition and Consumer Commission, to prose- cute Domino's for breaching consumer laws.

Lazy Cat Alerts Owner Of Home Burglary

A cat is being hailed a hero after alerting his owner to a break in.
Strider, the cat, has earned the repu- tation of being fat and lazy according to its owner, Barb Gansberg.
Barb and her husband Kerry laid down ground rules in the home which included no wandering into the bed- room.
Barb was alone Tuesday morning getting ready for work when Strider strolled into the forbidden zone.
"And he sneaks into my bedroom like this. He's looking at me. I thought what the heck is wrong with you. And he sat right here,” Barb Gansberg said.

"So I just yelled hey, and off they went," Barb Gansberg said.
They made it one block before police caught them.
Strider had earned some street cred in his living room.
"Yeah he may have saved the day. I didn't know the cat had it in him," Barb Gansberg said.
"He's a hero for the time being. But all good things must come to an end unfortunately," Barb Gansberg said. “He’s still fat and lazy and I don’t expect that to change.”
