Practice Highlights
Government Contracts Internal Investigations. Our Team has assisted government contractors with a broad spec- trum of investigations. Our significant experience includes investigating internal hotline complaints, responding to Government subpoenas, and guiding clients through audits (including DCAA and GSA). These matters involve an- alyzing overcharging allegations, determining whether and how to make a disclosure under the Federal Mandatory Disclosure Rule, assessing allegations relating to the Federal and state statutes prohibiting the provision of gifts, bribes and kickbacks, and a wide-range of allegations relating to labor mischarging.
White Collar Investigations. Our team includes a deep bench of former Federal (Assistant U.S. Attorneys) and state prosecutors (Deputy District Attorneys) with many years of experience handling white collar crimes, including negotiating deferred prosecution agreements (DPAs) and non-prosecutions agreements (NPAs) to achieve minimal impact to our clients. This experience includes responding to search warrants, grand jury subpoenas, government witness interviews, indictments, and related criminal charging documents. Often criminal investigations run parallel to civil lawsuits or administrative investigations, and our team works seamlessly to defend our clients against all aspects of the allegations.
International Trade Investigations. Our international trade lawyers have assisted multinational corporations in a wide-variety of multijurisdictional investigations. We have helped companies respond to allegations in response to government enforcement actions and internal reporting involving the Foreign Corrupt Practices Act (FCPA) inter- facing with the DOJ and SEC, export controls (ITAR and EAR) regulated by the State (DDTC) and Commerce (BIS) departments, and U.S. sanctions matters relating to OFAC enforcement actions.
Protecting Organizational Integrity. The Sheppard Mullin Organizational Integrity Group (OIG), a dedicated subset of our investigations practice, helps companies and organizations defend threats to their organizational integrity by developing and implementing compliance programs that stick, responding to and defending against government investigations and litigation, and resolving reputational threats. Solving serious legal and organizational challenges requires assessing and addressing multiple organizational priorities, including the organization’s mission, values, reputation, stakeholder interests, and business imperatives. We look beyond a narrowly defined legal approach to understand and align various and sometimes competing demands. We view legal problems broadly, through a wide-angle lens, to help our clients focus on the underlying issues that can be the source of a legal problem as well as the key to its solution. We identify the root causes of problems to craft solutions that are practical, effective, and sustainable. We develop solutions that address each organization’s unique risk profile and align with its mission, values, and obligations.
