 There is a reason plaintiffs’ lawyers love email and corporate defense counsel hate it. With admitted hyperbole, if it’s an email that supports the defendant company’s position, it will be lost for all eternity. If it’s an email that makes the company look bad, it will have been forwarded to 100 people within and outside the company. Unfortunately, the same traits that make email such a relied-upon tool in business – it’s easy, it’s impersonal, and it’s informal – also make email a potent weapon in litigation. This CLE program uses actual emails from actual investigations and litigations to develop a practical list of do’s and don’ts that should be part of any large organization’s in-house training program.

  Organization Integrity 201: Rebuilding The Brand Before Or After It Has Been Tarnished

From police departments to universities to corporations, there is no shortage of institutions in the U.S. undergoing organizational reform. Reform initiatives come in a variety of shapes and sizes, and are instigated in a variety of ways, from Government-imposed reforms, to litigation-driven reforms, to self- initiated reforms. Whatever the incentive, corporate reform initiatives are complex and, if not undertaken carefully, can be perilous. Of course, if not undertaken at all, the consequences can be worse than perilous. Drawing from the DOJ memorandum for the prosecution of corporations, the FAR Suspension/Debarment rules, and the FAR’s business ethics/conduct regulations, this CLE program explores how the federal government views internal compliance programs, compliance-focused infrastructure, and business ethics programs – and how to structure a reform effort to maximize its effectiveness to implement change, sustain change, and mitigate litigation risk.
