“Our employees have been waiting since November 2013 for their votes to be counted,” Gerawan said in a Sept. 18 news statement. “After a historic strug- gle, they achieved that right, in spite of the efforts by the UFW and the millions of taxpayer dollars spent by the Agri- cultural Labor Relations Board to deny them that right.”
The state labor relations board had declined to count the ballots from the 2013 election, questioning the true sen- timents of Gerawan workers who voted on the issue.
Marc Grossman, a spokesman for UFW, said the issue remains in doubt despite the court’s Sept. 12 ruling.
“The Agricultural Labor Relations Board still has to consider whether a free and fair choice was prevented by all the illegal conduct by the company documented in the 82-page decision by the full ALRB board in 2016, and the earlier 192-page decision by the state administrative judge,” he said.

tion and conciliation was unconstitutional. The UFW said after the ruling that the grower should pay more than $10 million that the union said the company owes its employees through the 2013 ruling.
But in the Sept. 12 decision, the state’s high court called the labor rela- tion board’s approach “fatally inconsis- tent” with the Agricultural Labor Re- lations Act “because it fails to accord sufficient value, weight and important to the employees’ fundamental right to choose via secret ballot election. In- deed, it virtually ignores that right.”
Gerawan — the largest tree fruit grower in California with thousands of direct-hire employees — has a history with the United Farm Workers going back to 1990. In a secret election that year, Gerawan employees voted to be represented by the UFW. After rejecting Gerawan’s challenges to the election, the ALRB certified the UFW as exclusive bargaining representative in July 1992.
The two sides began negotiations in November 1994 and held at least one negotiation session but did not reach a contract agreement.
It was at that point that Gerawan said that the UFW never contacted the company to begin future negotiations
for a contract. The two sides had no formal contact until October 2012 when the UFW made a renewed demand to bargain. According to court records, Gerawan asked the UFW to explain its absence between early 1995 and 2012 but the union refused.
More than 10 bargaining sessions took place in early 2013, but the two sides couldn’t agree on a contract. In March 2013, the union filed a declaration with the ALRB requesting mandatory mediation and conciliation. Gerawan op- posed the request, claiming the statutory prerequisites had not been met and that the UFW had abandoned its status as the bargaining representative.
Later that year, the board denied Gerawan’s opposition and referred the parties to MMC. The board instituted a mandatory contract between the par- ties, prompting a Gerawan appeal and the decertification election.
In the news statement, Gerawan said the 2013 vote left no doubt what his employees wanted.
“It is a ringing endorsement of their right to choose, and a repudiation of concerted, unlawful, and anti-demo- cratic efforts to deny them that right,” he said.

A 59-year-old Reedley man suffered head injuries when the bicycle he was rid- ing was struck by a truck Sept. 12 while crossing Manning Avenue.
Ralph Rodriguez was transported to Community Regional Medical Center in Fresno, where he initially was listed in critical-but-stable condition.
In a Sept. 18 comment to The Exponent’s Facebook page post on the accident, Rita Mae Rodriguez said her father was going
to pull through.
“My dad’s getting better,” she posted.
“One day at a time, God’s covering him.” Rodriguez was riding his bicycle when he was struck by a pickup truck just east of the Manning intersection near I Street in Reedley. The accident happened sometime after 3 p.m. next to the railroad tracks in
the westbound lane of Manning Avenue. The crosswalk area at the accident scene features flashing ground lights that alerrtas motorists when the pedestrian pushes the
button to activate the lights.
Police arrest DUI suspect after brief pursuit

Reedley police arrested a 29-year-old Reedley man on suspicion of driving under the influence and evasion on Sept. 12 after he sped away during an attempted traffic stop and led a brief pursuit into Tulare County.
Police attempted to stop the vehicle Jony Aguilera was driving at the intersection of Reed and Olson shortly after midnight, according to po-
lice Sgt. Bryan Pelayo, but Aguilera didn’t stop and sped south on Reed Avenue.
Police pursued Aguilera to Avenue 416 (Mountain View Avenue), where he turned west. The chase briefly reached speeds of about 110 miles per hour, before Agu- ilera slowed to turned south onto Road 38. He lost control, struck a guardrail and went down a partial embankment before comment to a stop.
Pelayo said police initially suspected that Aguilera was driving a stolen car, but that wasn’t the case. In addition to the DUI and evasion charges, Aguilera also was charged with driving on a suspended license. He was booked into the Fresno County Jail.
It also turned out to be a busy weekend for DUI cita- tions for police. Five arrests were made, two on Sept. 15 and three more on Sept. 16.
