Securing Admissions
One of the most important objectives in a deposition is to secure admissions to win at summary judgment, mediation and trial. Getting a witness to agree with you on critical, central questions can result in a resounding win. This exercise addresses how to secure admissions.
EXPLANATION
Participants learn to secure favorable admissions.
EXERCISE
Identify a witness you cross-examined in deposition and describe the case and the role of the witness in the case to the participants. Explain the importance of admissions, how to secure them and how to use them. Have the participants question you (as you role play the witness) in a manner to try to secure admissions.
LESSONS LEARNED
If you can secure admissions in a deposition, you are well ahead of most who fail to do so. Getting a witness to admit to a fact or issue crucial to your case can result in a win – a summary judgment win, a win at mediation or a win at trial.
