Appropriate Objections
When defending a deposition, an attorney is limited in how to object to questions. Typically, one is limited to object to the form of the question, unless a privilege is being treaded upon. Lawyers must learn what deposition objections are appropriate.
EXPLANATION
Participants learn which objections they can make in a deposition.
EXERCISE
Discuss with participants what objections they can make in a deposition and when. When objecting on the basis of privilege, explain to participants when it is appropriate to make such an objection and how to raise the objection. Run through various questions which should prompt objections and discuss what objections should be made and why.
LESSONS LEARNED
This exercise teaches when to make objections and how to make objections. Each jurisdiction has its own rules as to when and how to object to a given deposition question.
