safely and productively. If the medication in question may impair mental or motor functions, the associate shall notify the Community Leader and/or Human Resources representative of the prescription as soon as possible after receiving the prescription. In such instances, the Company reserves the right to reassign the associate to a position that is less critical or safety sensitive, or initiate a medical leave until the associate is no longer required to take the prescription medication. The associate is asked to keep the nature of the medication and the condition for which they are prescribed confidential and is not required to provide information other than to advise that he or she is taking prescription medication which may impair performance or safety. Unless otherwise authorized, associates should bring no more of their medication to the location than is reasonably necessary for use during their work shifts. Certain prescribed medication and over-the- counter medications, as well as other substances, may cause a positive drug test result. Use of any such substances should be disclosed to the testing facility.
! Associates may not manufacture, purchase, sell, distribute, dispense or transfer possession of drugs or alcohol on Company premises, at Company sponsored events, or at locations under the Company's control.
! Associates shall not test positive for drugs or alcohol or prescription medications that affect job safety or performance or which are not used in accordance with the prescription or in a manner or for a purpose other than as prescribed.
! Associates may not refuse to submit to a drug test in accordance with the procedures set forth below. Refusal to submit to a drug test is grounds for discipline, up to and including discharge.
! The unauthorized removal of any property belonging to the Company or its residents, including
medications, controlled substances or narcotics as well as the diversion of any medications, controlled substances or narcotics (which includes expired medications) is strictly prohibited. In the event an investigation confirms that an associate has obtained drugs for personal use or gain by diverting them from a resident or by taking them from the Company, the associate will not be eligible for the voluntary rehabilitation program (described below) and will be immediately terminated.
Drug and Alcohol Testing
The Company reserves the right to test and screen for any and all drugs and alcohol including, but not limited to, amphetamines, barbituates, benzodiazepines, cannabinoids, cocaine, methadone, methaqualone, opiates, phencyclidine, or propoxyphene, in accordance with applicable laws, rules, and regulations, to protect the safety of its workplace and health of its workforce. Drug testing will be conducted in accordance with Company policy and will be administrated in accordance with applicable state and/or federal laws, rules, and regulations and enforceable to the full extent allowed thereunder. It shall be a condition of employment or continued employment for associates to submit to a drug test and refusal to submit to a test, or any attempt to invalidate or circumvent the testing process, may result in termination of employment or withdrawal of the applicant’s employment offer. The Company conducts drug and alcohol testing in the following situations:
Pre-employment: All associates, to whom a conditional job offer has been extended, including former Associates who are rehired or reinstated must pass a pre-employment drug test. Any applicant with a positive result will not be hired and the conditional offer will be rescinded.
Transfers: An associate transferring to a different location within the Company may be required to complete a new drug test.
Leave of Absence: Any associate who has been on an extended leave of absence (30 days or more) may be required to submit for drug testing prior to reinstatement.
