Task: Pre-Gant Searches
Davis v. United States, 131 S.Ct. 2419 (2011).
The exclusionary rule does not apply to searches incident to
arrest of vehicles which resulted in seizures before the Arizona v. Gant
decision. The purpose of the exclusionary rule is to deter law
enforcement misconduct. Since these seizures occurred under the
existing rules at the time, the exclusionary rule’s purpose would not be
served by suppression of evidence.
