Plenary 3 Facilitated Handovers: Let’s Talk About Our Duty of Care.

This presentation will re ect on the experience of Family Consultants employed by the Federal Circuit Court and Family Court of Australia when ordered to facilitate handovers requiring children to spend time or live with a parent when the child is rejecting that parent.
Using de-identi ed case illustration, the presenters will examine the experience of these handovers from the child’s perspective, from each parent’s perspective and from the perspective of the Family Consultant and other Court personnel.
Our experience in facilitating such handovers has prompted us to consider a range of strategies for Family Consultants and lawyers which include: careful planning and preparation; communication with different professionals and Court staff; and complex duty of care considerations for the child and each of the parents.
From this unique clinical experience, the presenters will make suggestions for the evaluation and formulation of recommendations in forensic reports in these complex family circumstances.
Launch of YPFLAG Report
Throughout 2016 & 2017, the South Australian Family Law Pathways Network conducted a pilot project, the ‘Young Peoples Family Law Advisory Group’ which obtained feedback from a group of young people who had experienced the family law system. This brief presentation will of cially launch the report from this project, and hear from its ambassador, the Honourable Diana Bryant, AO, QC and participants of the YPFLAG project about what we can learn from listening to the voice of children and young people across the family law system.
