ORDINANCE NO. 2018-07
AN ORDINANCE PROHIBITING THE USE OF ENGINE AND COMPRESSION BRAKES IN
THE VILLAGE OF STURTEVANT, WISCONSIN, PROVIDING PENALTIES THEREFORE
AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO POST APPROPRIATE
SIGNS
WHEREAS, the Village Board of the Village of Sturtevant, Wisconsin, finds that the use of
motor vehicles brakes which are activated or operated by the compression of the engine of a motor
vehicle disturbs and disrupts the public peace and quiet and, therefore, finds that it would be in the best
interest of public health, safety and general welfare to prohibit the use of such brakes within the Village
limits of the Village of Sturtevant;
NOW THEREFORE THE VILLAGE BOARD OF THE VILLAGE OF STURTEVANT,
WISCONSIN DO ORDAIN AS FOLLOWS:
Section 7.15 of the ordinance of the Village of Sturtevant is hereby created to read as follows:
7.15 COMPRESSION BRAKES PROHIBITED.
Section 1.
The purpose of this ordinance is to prohibit the excessive, loud, unusual or
explosive use of engine and compressed air-braking devices within the Village of Sturtevant.
For the purposes of this ordinance the following words and phrases are
defined as follows:
“Engine retarding brake” means a “Dynamic Brake,” “Jake Brake,” “Jacobs Brake,” “CBrake,” “Paccar
Brake,” transmission brake or any other engine retarding brake system that
alters the normal compression of the engine and subsequently releases that compression.
Section 2.
It shall be unlawful for the driver of any vehicle to use or operate or cause
to be used or operated within the Village of Sturtevant, between the hours of 10:00 PM and 7:00AM, any
engine brake, Compression brake or mechanical exhaust device designed to aid in the braking or
deceleration of any vehicle that results in excessive, loud, unusual or explosive noise from such vehicle,
unless such use is necessary to avoid imminent danger. Such prohibition shall be applicable to any public
highway within the Village.
Section 3. Any person violating the provisions of this ordinance shall have committed a traffic offense
and a penalty shall be imposed as provided in Section 7.20 (2) of the ordinances of the Village of
Sturtevant.
Section 4. The Director of Public Works is authorized and directed to post appropriate signs consistent
with the provisions of this ordinance.
Section 5. All other terms and provisions of Chapter 7 shall remain in full force and effect unless
specifically modified herein.
Section 6. This ordinance shall take effect the. day after passage and publication as provided by law.
