26.1 In the event of death of the client, payment for two weeks will be due in lieu of notice period.
26.2 In the event of the death of the client, Ranger Home Care will provide a final statement of account to the client’s estate, following which the payment referred to at 26.1 will remain payable by the client’s estate.
27. Hospital Admission
27.1 In the event of a hospital admission of the client, the live-in carer will remain in situ for two days, if the hospital admission is for more than two days, Ranger Home Care will pause the payment period until the client returns home, with the usual circumstance being the carer will leave the property until such time as the client returns, unless alternative arrangements are agreed. If the carer leaves, we cannot guarantee the same carer will return. If you keep the carer insitu then the
normal cost will be incurred.
28. Governing Law and Jurisdiction
28.1 The contract and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the Law of England and Wales.
28.2 The parties irrevocably agree that the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the contract or its subject matter.
28.3 If any term of this contract is held to be illegal, invalid, or unenforceable, in whole or in part, such part shall be deemed not to form part of the contract but the legality, validity or enforceability of the remainder of the contract shall not be affected.
29. Entire Agreement
29.1 This agreement, the Client’s Handbook, and the Personalised Client’s Care Plan available electronically on PASS, constitutes the entire agreement between the parties and supersedes and extinguishes all previous drafts, agreements, arrangements, and understandings between them, whether written or oral, relating to its subject matter.
29.2 Each party agrees that it shall have no remedies in respect of any representation or warranty (whether innocently or negligently) that is not set out in this contract. Each party agrees that it’s only liability in respect of those representations and warranties that are set out in this Contract (whether innocently or negligently) shall be for breach of Contract.
