TERMS & CONDITIONS

Return Policy
a) Westgate Mfg. is committed to providing 100% customer satisfaction. Returns are allowed for any reason on most items within 30 days of purchase with
no restocking fees.
b) ltems must be returned in original packaging, including parts and manuals.
c) All items must be returned in new condition, with an RGA form issued by Westgate Mfg.
d) d) Return of factory or user modified items (EG: custom finish color, installed options such as battery backup, sensor, etc.) will not be accepted. Orders for
products including assembly / installation of optional features or custom finish color may not be cancelled after Westgate’s purchase order receipt
confirmation has been sent.
e) Due to the fluctuating price of copper, all purchases of wires and cable are final.
f) Westgate Mfg. strives to provide premium quality products exceeding UL standards and consumer expectations. All terms are under the Westgate Mfg.
warranty. For the length of warranty, refer to each item's catalog page.

Freight & Shipping Terms
a) All shipments may be shipped to the distributor's warehouse, or any other location within the contiguous 48 United States. There is no drop-ship charge.

b) Prepaid freight policy available within the contiguous 48 United States (excluding Alaska and Hawaii). Please contact your agent or Westgate for
minimum order value for your location.
c) Customers may use their own carrier for shipping.
d) All local, ready to ship, in stock, inventory will ship the same day; Or, be ready for Will Call the same day. However, Westgate Mfg. shall not be held
liable for any delay in shipping or handling of goods.

Purchasing Terms and Prices
a) There is no minimum purchase requirement on orders.

d) Prices in Price book are for reference only and do not indicate maximum prices.
e) Westgate reserves the right to charge any price based on its sole judgement.
f) All prices round up to the nearest cent; consequently, actual invoice prices may vary slightly.
g) g) 30-day credit terms are available to purchasers with approved credit. A 1.5% finance charge per month may be assessed to accounts with past due
balances.
h) Purchaser will be held responsible for any returned check fees or legal fees due to failure of payment.
i) Westgate Mfg. reserves the right to refuse credit to anyone.

Product Guarantee
a) a) Westgate brand products are warranted against defects in material and workmanship. In the event of any defects, Westgate Mfg. promises only to repair
or replace the defective products. Westgate Mfg.’s liability is expressly limited to the cost of the initial product. Any consequential damages arising out
of the event of a defect are expressly excluded. No labor, shipping, installation, or equipment rental cost will be reimbursed. Product warranty only covers
replacement, repair of the product, with the same or similar model.
b) b) Westgate Mfg. warranties all of its products against manufacturing defects for the full period as indicated on the product AS LONG AS THE FIXTURE
WAS PURCHASED FROM AN AUTHORIZED WESTGATE DEALER, and installed in accordance with factory manual and instructions and the National
Electrical Code.
c) Please review each product page for warranty terms.
d) Natural disaster and acts of God are not covered under warranty.

Defectives Policy
Inspect
Inspect products upon receipt. Broken lenses and other visible defects must be reported within 7 days of receiving the shipment. Defective products
during warranty period will be replaced with the same item. If an item has been discontinued a newer version with similar specs will be recommended.
I) In such a case, the customer will be invoiced for the difference between the cost of the new item and the last published price of the old one.
II) If the customer does not accept the substitute, the credit amount will be based on the latest published price.

The specifications and designs of our products may change in accordance with new codes and standards at any time without notice.
IMAP Policy
Westgate customers shall be subject to the Westgate iMAP policy. To be in compliance with the Westgate iMAP policy, advertisements of Westgate
products identified in the Westgate iMAP pricelist with an iMAP price will advertise the Westgate product(s) at prices no lower than the prices listed in
the iMAP column of the then current Westgate iMAP price list as issued from time to time by Westgate MFG.

All purchases from Westgate are under this and other terms and conditions instructed by Westgate.
