Legal Opinion -
By Rajesh Jagasia-Legal Advisor
People from all over the World started coming to The United Arab Emirates (UAE) since
1971. A few of them chose to make it a home, have families and have long-term careers.
The location of the UAE has an advantage for trade between various countries.
The UAE has a Civil Law and Sharia Law system. Visionary leaders brought major changes
in the country’s legal system in 2003. It was the year when expats were allowed to
purchase property with freehold ownership laws.
The ever-changing social and economic life of the country led to a series of evolutions in
laws. Recently, more changes are introduced to protect personal data, tackle fake news
and stronger copyright rules. Investors and entrepreneurs will be allowed to establish
and own onshore companies in almost all sectors. The new laws provide more protection
for domestic workers and effectively decriminalise consensual relationships outside
marriage.
Copyright and Intellectual property laws were implemented strictly from 1996-97. I am
proud to be a part of those changes. Enforcements were fully implemented, and strict
action was taken in the watch industry, cosmetic industry, shoe industry, electric and
electronic industry, and tobacco industry. Our firm Kamraj Consultancy was at its peak
seizing counterfeits in the United Arab Emirates, especially Dubai, in the year 2003. We
seized the counterfeit cosmetics manufacturing factory in China after which all the
counterfeit of that brand completely disappeared from the UAE market.
We established Right Justice and Advocates and Associates LLC in 2018. Since then, the
journey has been amazing with clients from all nationalities. We cater for clients with
International Recoveries, Debt Collection, Civil/Criminal cases, and now Anti- Money
Laundering.
Legal System, especially in Dubai is very transparent, justice-oriented and unbiased. All
who go to the Courts of the UAE can expect speedy justice. New laws decriminalised
suicide, changed regulations on alcohol consumption and boosted women’s rights, among
others.
Last month Abu Dhabi instituted new laws for the emirate’s non-muslim residents.
It allowed them to conduct procedures such as inheritance claims, divorce and child
custody disputes in the jurisdictions of their countries of origin.
These changes in the legal system by the UAE Government is a new move to be at par
with international legal scenario. Human Rights Protection is of utmost importance for
the country leaders.
We expect to see more changes in the legal system to make it more effective in providing
fair trials and justice.
