Thank you for your further letter of 31 March 2016.
In the absence of requested emails and letters in support of various [edited] quotations I will still attempt to meet your deadlines, but in the meantime and for the avoidance of any doubt, we (the Directors of MHML), would confirm our rebuttal of most if not all of your’s and Mrs Hillgarth’s observations to date.
We have all original invoices referred to in your 23 March 2016 letter available for inspection. We also have photocopies of all invoices. I suggest we have both originals and copies couriered over to your office requiring only the originals to be returned after satisfaction.
As regards your cited number of instances suggesting the possibility of fraud on the part of MHML and its directors, I would also confirm are all denied. I am preparing at some length a comprehensive reply to each of the approximate seventy-five paragraphs in your letter of 23 March 2016, some of which maintain other misfeasances and irregularities, including a request that MHML immediately resign voluntarily to avoid a court order to enforce our dismissal based on the various malpractices your have inferred in all your correspondence to date based, one presumes, on statements made to you by Mrs Hillgarth.
As we consider most if not all comments to be unjustly levied against ourselves, having little or no relevance to the good management we have strived to achieve for the benefit of not only ourselves as lessees and Directors of MHML, but for all other lessees including Mrs Hillgarth, we decline to resign voluntarily.
Mrs Hillgarth has a somewhat cavalier attitude to authority as is evidenced in these few [of many more] examples of her correspondence with previous Managing Agents. You will note multiple references to LVT, threats, demands, repeated ad nauseum requests for duplicate information and an apparently stubborn refusal to follow advice or instructions culminating in alienating yet another estate manager.
You will note the dates of this small sample of to-and-fro correspondence runs from 19 January 2005 to 14 April 2005, being approximately 3 months. MHML have endured this barrage of LVT, threats, demands, repeated ad nauseum requests for duplicate information, plus an application for an [abortive] RTM, plus queries on her behalf from Scots Group, (one presumes), her accountants, for nearly six years non stop.
A definite mea culpa cannot be denied for some of the more flowery phrases used in some of the 1600 odd emails composed and sent by MHML, as well as in some of those emails replied to, towards the middle to end of 2014 when I’m afraid my/our patience, fatigue and exasperations were becoming exhausted.
