Thank you for your letter of 23 September received on my return to Mitre House, along with a large tome re: Third Tier Tribunal which will take some careful considerations. As you will be aware, you did actually mention this documentation in your phone call/message of 9th August at 8.00pm informing me that “You will get the Witness Statements of Mrs Hillgarth and Tony White which you’ve asked for later this week and they’ll be attached to a formal Notice under s22 etc and you’ll then have a fixed period to respond etc...”
Obviously it was not sent as indicated and one presumes I still have 30 days from receipt to carefully peruse and comment, and to agree or not to your demands. You will be in receipt of my full and detailed responses to all points raised in your Notice by latest close of play Friday 21st October at your 9th Floor offices, if not sooner.
One hopes the Tribunal will concur as appropriate given the time it took you to prepare and send, and me to receive.
As regards the query raised in your recent 23 September letter, any funds that were not required in year ended 2014 period (your reference being £11,974.54) “disappeared” into Reserves. A fact mentioned on multiple occasions in various emails to Lessees pre and during the Works, outlined in some detail in my 14 June 2016 letter of reply to you, and stated on the covering letter sent to all Lessees with the year ended 2014 Accounts Summary .
As regards Mrs Hillgarth somewhat obtuse email request, I think we can agree it is a proof perfect example of exactly what ourselves and previous Agents have long experienced and suffered in our dealings with her, namely a repeat demand (within 30 days) that is already under review and has been well identified as both contrary and statu- torily ill-timed and the subject of various litigious threats over a 6 month period of very lengthy and comprehensive correspondence, followed overnight by a subsequent revised irrational demand (for the next day), followed again by return of both yet another revised demand (over a week-end) and the now anticipated familiar jibe at me and MHML. As has been made abundantly clear on numerous occasions, statements made by Mrs Hillgarth are both misleading and untrue, such as MHML misappropriating the monies received for Window Repairs, my personal use of AR Lawrence personnel in renovating my flat, our non full payment (2 x £1200) to supplier BES Electrics (Nigel Brooks), AR Lawrence’s statement that the Water Tank was on their schedule of works etc and most pertinently as the two examples below (still stubbornly unacknowledged nor answered despite now three requests) amply evidence:
