Your Notice bundle consisted of a two page covering letter, an 18pp Preliminary Notice, 14pp of itemised docu- ments, with one running to 53pp and the others averaging 5pp each, and a 20pp Witness Statement from Mrs Hillgarth - dated I might add some two weeks after your refusal to oblige my request to have sight of it?
With reference to your Preliminary Notice and my attempt at answering yet again all the very same points raised in all previous correspondence to date including mosts notably the recent Crime Report.
More time, more costs, but I’m attending to it as promptly as possible, but regrettably it’s taking a little longer than anticipated and I must rely on the full 30 days, as opposed to the twenty one I thought would suffice to make my indicated 21 October delivery.
In the interim, I am enclosing your (answered) Crime Report which, save for Mrs Hillgarth’s 20pp Witness Statement and various new accusations does pretty much cover the multitude of other inaccuracies and untruths made by your client to date (incl. supporting documentation as usual) in all correspondence including those made in your initial 13pp 23 March 2016 letter.
I also enclose in case you have not been advised, copy correspondence between Mrs Hillgarth and myself and indeed other Lessees to whom Mrs Hillgarth copied her query, which was identical to your letter to me dated 23 September 2016 which was replied to comprehensively (I thought) by me on 29 September 2016.
Obviously not, as Mrs Hillgarth simply repeated the same query yet again and copied all Lessees.
I consider this a proof-perfect example of Mrs Hillgarth’s duplicity adding to her recent typical contrariness when firstly requesting (the very same) documents within 30 days, followed within 12 hours, a revised deadline of “tomor- row”, followed by return of reply, within three days over a week-end? She also stated I had “promised” to send her the documents. To date, despite my request for her to supply me an email from me stating this “promise” none has been forthcoming.
Somewhat similar to various other supposed statements, such as:
“By way of explanation to the leaseholders Mr Brown-Constable has asserted in correspondence that the lease- holders, and in particular Mrs Hillgarth, were insisting that certain items within the Schedule of Works should be excluded in order that other improvements outside of the Schedule of Works could be included.”
