Thank you for your letter dated 17 June 2016.
You might recall I extended my lease in 2014 and you dealt with my friend and Solicitor, Robert Wood, who is fully aware of this present situation regarding Mrs M. Hillgarth of Flat 5, Mitre House, 124 Kings Road, London SW3 4TP
He is presently progressing proceedings against Mrs Hillgarth for breaches in her lease covenants. Mrs Hillgarth was also initially one of the four Directors of our Head Lease company, Mitre House Management Limited. Due to various reasons most pertinently, again as you may recall, a failed attempt at an RTM application in 2013, Mrs Hillgarth was requested to resign as a Director of Mitre House Management Limited in September 2014.
As such, Mrs Hillgarth and our company, most especially myself, do not see eye-to-eye, on anything.
Your letter makes clear that our Freeholder, Royal London Mutual Insurance Company Limited, has received a number of troubling reports from the leaseholders [of Mitre House] regarding the management of the residential parts of the building by Mitre House Management Limited (the "Company").
Might I enquire if indeed there are other named leaseholders making direct personal troubling reports or you are relying on Mrs Hillgarth’s or her Solicitor, Mr. Begg’s inference that there are other leaseholders in agreement.
I ask that query because since I received a letter from Mrs Hillgarth’s Solicitor on 23 March 2016 I have been in very lengthy correspondence with Mr. Begg and was under the impression that all accusations levied at both myself and (the "Company") had been more than adequately explained, denied and disproved, with supporting paperwork.
Referral was also made by Mr. Begg to RBK&C (Stephen Belafonte/Tenancy Relations Office) from whom I received a letter and subsequently attended his office. I was able to again prove, with supporting paperwork, accounts etc [most pertinently our year ended 2014 accounts dated 30 May 2015 to which you refer - I also showed our accountants full certification and invoice etc], that the various accusations levied against myself and (the "Company") were misplaced and erroneous.
