Dear Michele -
Thank you for your lengthy reply in response to my lengthy one - in truth, your recollections are not quite as I recall nor indeed do I get the feeling you fully understand just how difficult you made a very simple, straightforward operation by not responding like everybody else did when requested to, and more annoyingly, expecting others to waste their time, on your behalf, whilst you holidayed in obviously blissful ignorance of our schedules, work-loads and indeed our holiday plans.
As I explained, there was no reason whatsoever that we needed to await the actual absolute deadline of Moday 15th August had you responded as requested to requests on 9 August requiring reply by 11th latest - why was it necessary for all involved to waste a whole mid summer holiday week-end just because you were being difficult and having absolutely no regard for those working on your behalf?
I'll give you one very simple example - you requested of me via email on 7/4/11 @ 19.03pm for a list of all leaseholder names, telephone numbers and email address (see attached_A) - and made clear it was urgent for 9.30am the following morning. Had I ignored that or indeed sent it direct to somewhere else, what would you have thought?
In fact it was sent to you almost by return (see attached_B) at 21.17pm - and again, slightly revised with additional telephone numbers at 8.19am the next morning, again ahead of your requested deadline due to holiday departure on the 8th - and you will note, you state:....and I am going to be away (Easter) from tomorrow until 26th April but cannot always get access to my e-mail. However, I'm always available on my mobile, so please don't hesitate to get in touch on 07850100247. My bet is that you would not have postponed your Easter holiday plans whilst awaiting getting important information requested by you from me which was not forthcoming! We all had to postpone schedules, including the Solicitor who, as I told you, had a funeral to attend in Spain on Monday 15th - the deadline.
You were also away 3rd - 8th May (with the deadline to serve first notice on 9th May), and again from 9th July during which the Auction took place on July 14th and again during all of August to include the final deadline of 15th August.
And do you actually expect me or anyone else to believe that you could have executed this whole project on our behalf, or indeed post Auction, solo, in the period from Rivers Edge serving notice on 9th March, then arranging and organising the requirement of a minimum of 5 leaseholders with required contact details and documentation (passport & utility bill) by May 9th, then attending (or at least aware of the outcome) the Auction on July 14th and then forming a limited company with required names etc of Directors all in place and correctly filed with Solicitors by final deadline of August 15th, all with a holiday (or business abroad) schedule as hectic as yours would appear to have been. And having to request important relevant information two or three times from some members and receive no reply? That's what we had to put up with and finally executed in your absence with difficulty and made much more difficult by your refusal to simply do as requested.
I do though fully appreciate that just possibly, had you used Forsters to represent you at all above stages, their (estimated) costing of £9000+ would make sense. By doing it the alternative route, your costs were only £2000 approx - but I regret, greatly at the expense of your fellow colleagues in terms of time and aggravation as outlined below:
1_ Despite a very, very simple request to all 5 initial participants on 25/4/11 (see attached_C), including you and also including Flat 3, (Maria Leoni-Sceti who was only helping us out to make up the numbers in case of need) for exact names, addresses to be used and copies of proof of identity documents to be sent to me for forwarding to YOUR Solicitors (ie even before we changed Solicitors i was still arranging everything on your behalf and that of Forsters), which everybody did by return including Maria, but you did not - preferring to send direct to Forsters. But when agreed Forsters were out and Mr Hodges was in, you then sent to him direct (way after the deadline), despite my request to you to the contrary as outlined in my specific reminder and email below:
In email from you 27/4/11 - you advised you'd sent your documents to Forsters, as of course, they were your first preference - but, because we'd by now agreed to change Solicitors, I immediately replied on 28/4/11 - Re: holiday and away, probably best to have your documents sent to me (copy of passport and any utility bill from your home address is OK) - Paul
But you did not and instead sent this email to me on 2nd May - For the attention of Christopher Hodges re the buying of Mitre House Headlease - Dear Mr Hodges, As I explained to Paul I am leaving tomorrow morning (3rd May) early and cannot send any documents before my return to the UK on the 10th of May. However I would like you to be aware that I wish that you serve Notice to the Headleasee on my behalf. I am aware that the deadline is on the 8th this is why I am sending this email via Paul. If you were able to send your documents and info to Forsters, as you told me in email 27/4/11 @ 22.46pm, how come not possible to simply re-send to me as requested by me on 28/4 before your departure on 3rd May?
Once this initial notice was met on schedule, without your full details, the next deadline was August 15th, by which time it was required that the names and addresses of those leaseholders wishing to proceed were fully documented and a company be formed with directorships and shareholdings in place.
But yet again, despite a very simple request via email (IMPORTANT) on 9/8/11 (which you received whilst in
France) to the remaining four of us (Flat 4 had dropped out) to supply directors details as follows:
