(reply) The subject of Surveyor known or not, has been well covered previously - oh dear - the typo yet again - already covered: it should say £105,019 not £115,019 - no mischief. It’s true: the works "are (were obviously) being done by your preferred contractor....! Her query should have been, who’s doing and how do we pay for the other works?
I can’t actually see any fraud or misinformation in that statement just 10 days into the works schedule. AR Lawrence were doing their workings, the Surveyor was doing his, the scaffolders’ had done their’s, I had already done the lift, the electrics, ordered the lights, installed the emergency lighting, built the meter cupboards, boxed in the wiring on all floors, arranged the BT wiring tidy-up and a multitude of other things necessary to accomplish and finish before the interior commences painting!!!
It’s called sticking strictly to a schedule which I tried and obviously failed to explain to Mrs “Property Developer” Hillgarth. Meanwhile AR Lawrence continued their workings all within the agreed s.20 budget of £105,019 which included vat and fees (the Surveyor etc).
And I was making savings wherever possible, many feasible savings from unnecessary workings which despite Mr White’s Witness Statement, I was not pleading poverty, but pleading common sense and economies required as we had a great deal more to fund over and above his scheduled works budget - all for the benefit of all lessees, including the un- grateful and duplicitous Mrs Hillgarth if she still maintains that either no works outside of the schedule were required by her or worse still I was telling lessees that Mrs Hillgarth was insisting we reduce the works schedule to permit additional workings - unbelievable?

To say that nobody knew of a Surveyor with their subsequent costs is ridiculous. Mrs Hillgarth is on record as demanding we use her Surveyor, Courtney Manton, from Best Gapp. Surveyor was mentioned a hundred times - every time the Schedule of Works was mentioned in all correspondence.... our Surveyor’s Schedule of Works. It’s totally ludicrous to say nobody knew we had a Surveyor and seeing as a Surveyor charges fees it doesn’t take too much to put that together with the budget which stated unequivocally, including vat and fees.
I have already allured to her meeting on 23 May 2014 re: various points (ref AAA). And if 20 she then hadn’t realised there was a Surveyor on board then I can’t help you further.
According to Mr Brown-Constable in a letter to Mr Begg of 14 June 2016 (see Item 8) the service charge reserves at that time amounted to only £98,262.75 to meet this budget of £105,019. Accordingly he collected in a further £18,000 (£2,000 per flat) to meet the expected shortfall of £6,756.25. The surplus of £11,243.75 was for "unforeseen works within the AR Lawrence quote ..... and for any out of the blue emergencies, the lift requiring repairs (quite usual) and any other repairs etc etc". In other words for contingencies.
(reply) all covered ad nauseum in extensive comprehensive correspondence - and do note the £11,243.75 was not touched save for the £858 overspend, and having done a great deal more within the initial £105,019 budget than expected when based on the Schedule of Works. Hardly fraudulent.
Having collected in the supplement of £2,000 per flat MHML had total reserves available to them of £116,262.75 (£98,262.75 plus £18,000). This was more than enough to complete the budgeted works, including a reasonable 10% contingency reserve. However according to Tony White's Witness Statement Mr Brown-Constable pleaded lack of money to Mr White in order to justify a
