Nobody including Mrs Hillgarth queried Reserves Utilised. In fact nobody queried our 2014 accounts until it was raised in your 23 March 2016 letter. Mrs Hillgarth never mentioned Reserves Utilised, only the invoices relevant to the works in 2014 ( on 17 December 2015).
I had asked you to supply me with correspondence allegedly sent by Mr Leigh Pemberton to me requesting information regarding accounts (since May 2015) as I have none on file exactly as previously explained in correspondence. This is just another vacuous unsub- stantiated accusation which I previously made clear is untrue. Please supply your evidence or desist from repeating unsubstantiated untruths.
My reply to Mrs Hillgarth on 17 December 2015 made clear it was close to Christmas and I’ll be back in form by New Year. I also explained that her request was somewhat out of time re statutory 6 months of our accounts (dated 30 May 2015) but I did not refuse her, simply stating I was recuperating till New Year. She did not acknowledge my reply which to be fair was expected, predictable and in keeping with previous demands.
The next I heard back was your letter dated 23 March 2016 to which I replied comprehen- sively. Admittedly reminding you of the 6 month rule and answering almost every query you’ve again raised subsequently and again today.
I do hope your (item 2) the 13pp 23 March 2016 INCLUDES my comments attached to it plus the multitude of accompanying documents or else it’s hardly worth the paper it’s printed on to an independent party perusing it, surely?
In fact the same goes for all our other subsequent correspondence with attached documents. I do hope those go off as well, or you might be accused of wasting the Court’s time - certainly you will be if I am not in receipt of both Witness Statements prior to their disclosure in Court.
We still offered to comply and supply the requested documents on 1st April 2016, (and did not refuse Mrs Hillgarth’s request of 17 December 2015 either) by courier to your office, which as is now well evidenced, was totally ignored and unacknowledged, allegedly because Mrs Hillgarth was tripping around the Sahara Desert and you were in bed with
16 pneumonia. And I too am now somewhat afflicted as my 8 August letter evidences.
Having failed to obtain any relevant information from MHML, Mrs Hillgarth made contact with Mr Tony White, the Managing Director of AR Lawrence. Mr White, who had not in fact been paid all the money that was owed to his firm by MHML, agreed to provide a Witness Statement (attached as Item 5) in relation to his involvement with the refurbishment.
(reply) the now infamous “Witness Statement”, written by Mrs Hillgarth with typical errors and signed blind by Tony White and undated which, had it been presented in court as evidence, someone would have perjured themselves. God knows what Mrs Hillgarth’s own “Witness Statement” looks like? Might be best you let me see a copy before the Fraud Squad peruses it. It can hardly be worth the paper it’s printed on if you are still maintaining she and other lessees under her tutelage did not seek quotes for the works they wished to be done. And were done economically within the budget by MHML.
And, as per my letters of 1 and 8 August, if her Witness Statement contains signed statements along the lines of paras (23) and (15) and others too numerous to list, it too, will not be worth the paper it’s printed on.
