All in all a very impressive situation having exceeded the external/internal budget by only £858 yet ended up with an interior far exceeding the most optimistic/pessimistic expectations. The £1,753 deficit (overspend) on the Service Charge accounts for YE2014 will now silence those who objected to, and persist in continuing to do so, to the raising of the Quarterlies for 2015. (f) In a covering letter with September 2015 Quarterly Demands from “PBC” to all lessees dated 15 September 2015 he writes: Apologies are in order and due from Flat 7, whose renova- tions have continued way beyond expected deadline/schedule, due solely to manpower, or rather the lack of it, or more truthfully the owner’s insistence on doing 75% of the work himself.
Management are happy to report no grumbles or complaints on any subject whatsoever from any lessee/tenant/visitor, save for an emailed query from one sub-letting lessee [“MH”] on the 2nd floor as to the (very) temporary use of some areas of the common parts for clean & tidy building materials, wood and such like. Those areas being the 3rd floor and the rear yard envi- rons, neither areas having any detrimental nor inconvenience whatsoever to any lessee other than those on the 3rd floor, who were advised in advance and on a daily basis. No damage to date to any common areas as the new lift interior also well evidences. (Folder_00 Item_65)
(g) In an email from “MH” to “PBC” dated 10 December 2015 (one year after works completed in December 2014) she advised: I vaguely remember requesting a break-down of the costs for the refurbishment @ Mitre House. Could you please forward this on as by now you should have all the documents in place as the accounts have been finalised [yes on 30 May 2015 some six months previously]. Just the information would be great. (Folder_00 Item_66)
“PBC” Comment: I think it has been well established in Mrs Hillgarth’s Witness Statement (para 85) that no request was made by her or indeed any other lessee and certainly Mrs Hillgarth does not do “vaguely” as both this whole affair and her Witness Statement makes abundantly clear. She nor any other lessee had not made any such request to my knowledge.
6_Indication of Additional Works researched/requested/required & RTM affair
(a) In a covering letter with March 2012 Quarterly Demands from “PBC” to all lessees dated 15 March 2012 he writes: Thanks to everybody for having paid the first quarter’s Demands promptly
allowing the Internal re-decorating to take shape. Various estimates for all intended works and improvements are still being very carefully negotiated and evaluated prior to commencement and will be advised to all concerned once finalised. In brief, we are spending approx. £3000 per flat (ie the overall expenditure incl, 20% VAT will be under £27,000) and can 100% guarantee each flat’s value will be enhanced well above that level once Mitre House is finished. We do have the opportunity to make this one of the most desirable, best maintained and most uniquely decorated (small) mansion blocks on the Kings Road, Chelsea.
These include: New and additional lighting throughout, including required Emergency lighting - all of which will be on new automatic sensors. The Lift car interior to be totally refurbished and external doors re-sprayed a more attractive colour than the battleship grey at present. All communal Windows (up the stairs) to be brought back to life and made to open/close properly. The Main Front Door (and exterior surfaces) will be stripped back to its correct Light Oak on both sides, with new brass door furniture and an interior Letter Box and a new strong door mat. A hall table with individual mail pigeon holes will be installed under a large mirror. The Terrazzo floor will be cleaned thoroughly (although, somewhat regrettably we are advised that it just can- not be restored 100% perfect, nor all surfaces finished with same matching colour, as indeed there are 3 different densities of shades of terrazzo in situ). There have been suggestions as to maybe carpeting which would help the awful acoustics - any comments? And finally, the whole place will be painted two colours throughout (one colour for walls and another for ceiling - we will not be retaining the panels picked out though - please!!).
