And Mrs Hillgarth’s immediate response again on 6th October (5 weeks now into the 2014 works’ schedule):
Paul,
For once in your life get the facts right.
In my e-mail on 29th September at 11:40 I stated:
“I fully understand that my tenant should not have the liberty of installing her own satellite aerial.
I am quite happy to contribute my share to pay for the installation of the community aerial with the Sky+ dual cable, and that it would make sense at the same time for tenant’s installation to be removed.”
In your reply at 11:51:
“great Michele, wise choice re tenants set up as all we’ll do is attach hers to the new setup with tidy cabling etc.”
At 12:56, I responded:
“as I said, I will be paying my share for the communal aerial and satellite”.
Subsequent e-mails from you that day brought up other issues and expenses, hence why I did not on that very day of 29th September give you a cheque for the TV aerial. But I have always said I would pay my share, the thing here is not to mix issues.
I also handed you a cheque when I came over on 30th September for £867.87 to cover my share of the cost of the water tank replacement.
There was, as we all stated previously, no need for a Section 20 letter. If instead of confusing and mixing issues you took what was in front of you this would all be sorted and the requisite funds would be in your hands.
And she continues in her email, again 6 October 2014 (5 weeks now into the 2014 works’ schedule):
Paul,
We are short £6,757.90 in order to meet the refurbishment costs of £105,019.00 If we divide this shortfall, it would cost each of the 9 flats £755.77
We agreed a nominal sum of £2,000 so that would cover the shortfall, and also the cost of the replacing the water tank and changing the TV aerial. All the flats agreed to this.
(my comment) show me or the court one single email evidencing that “All the flats agreed to this” meaning the £2000 per lessee (£18,000) was to cover the shortfall of £6757.90, plus cost of Water Tank and Communal TV/Sky (£13,147) - all of which now totals £19,904.90 - meaning we have an overdrawn situation in Reserves of £1904.90 and just possibly addi- tional works required or indeed any emergencies at Mitre House etc - WHAT A PATHETIC TYPICAL HILLGARTHESQUE LIE... and just one reason for my discontinuance of any fur- ther comments as the lies and innuendos just keep on a-coming.....
You are now blackmailing us, bullying us, insulting us and confusing us as usual.
We have all agreed that Section 20 was not necessary for the change of the water tank, and you will be fully responsible with your 2 other directors if any illness arises from contamination because you have ignored our agreement as the majority to change the tank and the cost would be met within the £2,000 given by each flat. (comment) the repeated stupid lie....
Michele
