Re: Section 21 & 22 Landlord and Tenant Act 1985 (Mrs Hillgarth/PFC Begg/Mitre House Mngt Ltd)
Our meeting today 11.00am Wednesday 8 June 2016.
We received a thirteen page letter dated 23 March 2016 requesting sight of various documents pertaining to the annual accounts year ended 2014. This letter was also very accusatory on many aspects.
We replied as requested in a letter dated 1 April 2016 and offered to bike over the requested documents. This letter and offer was not acknowledged nor replied to until 15 April 2016.
In the meantime, we had written two further letters with accompanying copy correspondence refuting all accusations and requesting firm confirmation of agreement that our correspondence did indeed evidence the misrepresentation and untrue nature of the various accusations.
We also made clear that once we received apologies we would consider sending the requested documents and we referred to the statutory requirement that requests for documents should be made within six months of the published annual accounts.
Our year ended 2014 annual accounts were dated 30 May 2015. The initial request for documents was not made until 17 December 2015, which was 17 days outside of the statutory 6 month period and we referred to the clause in the lease which made this perfectly clear as indeed it also does on the reverse of the Quarterly Demands sent to all lessees.

during normal working hours during the daytime on reasonable notice in writing at the Lessor’s premises
for a period of six months following the date of the Accountant’s certificate the audited accounts for the preceding Maintenance Year and the Lessor shall further supply to the Lessee a summary of such accounts
As such, Mrs Hillgarth, did not make a valid formal request to view any documentation from our YE2014 Service Charge Accounts (dated 30 May 2015) until her email request on 17 December 2015. We have also taken legal advice on this and it has been confirmed as such.
I attach a copy of the 2014 accounts dated 30 May 2015, Mrs Hillgarth’s email request dated 17 December, a copy of our Quarterly Demands statutory details and I have with me the various requested documents.
