STIPULAT IONS
which shall be deemed part of the Conditions
of Sale under which the properties are offered
:
1.-All Landlord's Fixtures and the Growing Timber and Underwoods except in
the Timber Lots will be included in the Sale.
2.-The Sale is subject to all outgoings, whether mentioned in these Particulars or
not, to easements, water rights, pumps, pipe tracks, existing rights of way and to the
created rights of way mentioned in the following Particulars.
3.-The Sale is subject to existing tenancies and to any claim to which the tenants
may be entitled on quitting, also to the Order and Regulations of the War Agncultural
Committee under the Delence of the Realm Act, as to ploughing of grasslands. The
agreements and leases, where in writing, can be inspected at the Solicitors' Offices by
appointment.
4.-There shall be comprised in the Sale of each Lot such appliances, water mains
and supply pipes and sewers and drains as lie wholly within that Lot and do not extend
to any other land and belong to the Vendor and such right in common with the Vendor,
his heirs and successors in title and all other persons from time to time entitled thereto
as the Vendor has to the passage of water and soil through all other water mains and
supply pipes, sewers and drains lying in but not wholly in such Lot and to maintain and
repair the same, but such last mentioned mains, pipes, sewers and drains and the right of
the Vendor, his heirs and successors in title, to use, maintain and repair the same, shall
be excepted and reserved to the Vendor and his heirs and successors in title.
5.-There shall also be excepted and reserved to the Vendor and his heirs and
successors in title out of or over any Lot the right to use, maintain and repair all appliances,
ways, drains and watercourses thereover or therein now used in respect of any other land
of the Vendor in the same manner as the same are now used. And there shall be in-
cluded in the Sale of any Lot the right to use, maintain and repair all appliances, ways,
drains, and watercourses now used in respect of that Lot so far as the Vendor can convey
the same. Any question as to any such user shall be settled by the Land Agents of the
Vendor, whose decision shall be final.
6.-The Lots over which the Vendor's Resident Agent may decide that a clearing
road and other reasonable right shall be given in connection with any Timber Lot shall be
sold and conveyed subject to the right of the Vendor, his heirs or successors in title to
pass and repass thereover along such road to and from such Timber Lot and to exercise
such rights to clear the timber and underwood thereover and for all sporting purposes, the
Vendor, his heirs or successors in title compensating the Purchaser of that Lot for un-
reasonable damage in clearing the timber and underwood, the amount of such compen-
sation to be payable (if any) to be settled by the Vendor's Resident Agent, whose decision
shall be final.
7.-The Farm Tenants holding under Yearly Lady-day tenancies have been given
notice to quit, expiring Lady-day, 1919, and, except where otherwise stated, arrangements
have been made with the Yearly Michaelmas Farm Tenants to determine their tenancies
also at Lady-day, 1919.
8.-The Present state of cultivation of the holdings is given in the following Particu-
lars, but intending purchasers must satisfy themselves as to the tenants' right to vary the
cultivations.
9.-The Plans and Particulars are believed to be correct, but their accuracy is not
guaranteed, and no claim can be admitted for errors and discrepancies.
10.-Where the Sporting Rights are let until 1st February 1919 the rent will be
reserved to the Vendor.
11.-Unless otherwise stated the properties are believed to be free of tithe rent
charge and land lax.
12.-In cases where holdings are divided into several lots and no permanent fence,
wall, or boundary exists between such divided lots, the Purchasers or Owners of the
several lots shall at their joint expense erect and maintain proper boundaries, fences or
walls.
13.-Any question as to Boundaries or ownership of Hedges, Walls, etc., shall
be settled by the Land Agents, whose decision shall be final.
14.-The area of the River Stour from the bank to the centre of the stream is
not included in the extent of any of the Lots which abut the River, but the Vendor's
rights and interests in such parts of the River will be conveyed to the Purchaser of
each Lot upon which they abut.
15.-Contracts will be made upon these Particulars, together with the “Revisions”
of this edition and Conditions of Sale, which will be issued later.
