Governor Ordered To Create New Voter Restoration System
BY IRIS B. HOLTON Sentinel City Editor
On Monday, U. S. District Judge Mark E. Walker is- sued a permanent injunction that requires Governor Rick Scott and the Execu- tive Clemency Board to cre- ate a new voter rights restoration process. Judge Walker gave the panel 30 days, by April 26th, to create the process.
Calling the former process “fatally flawed,” in his ruling, Judge Walker instructed the Clemency Board to “establish specific and neutral criteria to direct voter restoration decisions and meaningful specific and expeditious time con- straints.”
Judge Walker issued the judgment in response to a class action lawsuit filed by the Fair Elections Legal Net- work and the law firm of Cohen Milstein Sellers & Toll, PLLC, filed in March 2017. The organization rep-

resented 7 former convicted felons who sought their voter rights restored.
The ruling strikes down the system implemented by Governor Scott and his Cabinet members 7 years ago. Last month, Judge Walker said that system vi- olates the First and Four- teenth Amendments.
He further said, “The Board cannot rely on whims, passing emotions. Establish- ing safeguards against view-
point discrimination should be the Board’s paramount goal following this order.
“...And its rules must spell these criteria out with preci- sion.” He further stated in his ruling that the current sys- tem is “fatally flawed.”
Judge Walker’s ruling only pertains to the restora- tion of voter rights. Addition- ally, the ruling does not restore the voting rights of convicted felons.
