Real Estate Agent Indicted For Fraud
A 53-year-old Tampa Real Estate Agent has been indicted for bankruptcy fraud and falsifying records. The indictment was unsealed earlier this week.
David Lyle Morgan is facing a maximum of 30 years in federal prison if con- victed.
According to the indict- ment, Morgan, a licensed realtor, entered into a con- tract with a homeowner to sell a property in foreclosure. In order to prevent the Fed- eral National Mortgage Asso- ciation (“Fannie Mae”) from lawfully foreclosing on the homeowner’s property, Morgan engaged in a bank- ruptcy fraud scheme whereby he filed fraudulent bankruptcy petitions in the
homeowner’s name, without the homeowner’s knowledge or consent, just prior to the scheduled foreclosure sale dates.
These fraudulent bank- ruptcies invoked the auto- matic stay provision of the bankruptcy code and pre- vented Fannie Mae from conducting the sale and ob- taining title to the property. They also allowed Morgan to continue his efforts to sell the property to obtain illegal real estate commissions.
The indictment further al- leges that Morgan made false declarations on a fraud- ulent bankruptcy petition that he had filed in the name of the homeowner, impeding the proper administration of a bankruptcy proceeding.
