Two Polk County deputies have been placed on administra- tive leave because of a fatal shooting. The incident took place last Thursday evening.
According to police, Ms. Marjorie Pacuicrk, 75, called police to her home at 2938 Del Rose Drive, North, in Lakeland, in response to a family distur- bance. She told police that her son had become very angry and locked himself in his room and wouldn’t talk to her. She also in- formed them that he had a gun in the bedroom.
She wanted him to leave the residence because of his behav- ior.
The dispatcher told the mother to wait in the front yard for the deputies. When the deputies arrived, they entered the home, and then heard several gunshots. They ran outside and observed two men fighting, One of the men, later identified as John Pacuicrk, 53, had a gun in his hand. The other man was his 51-year-old brother, Theodore Pacuicrk.
Deputies commanded them to stop and drop the weapon. Police said Theodore Pacuicrk stopped fighting and followed their commands. However,
John Pacuicrk pointed the gun at Deputy Lee Smith.
Deputy Smith, 23, and Deputy Bernardo Del Valle, 28, both fired their service re- volvers, striking Theodore Pacuicrk several times.
The deputies began adminis- tering first-aid, but he died at the scene.
The deputies then located Mrs. Pacuicrk, who was inside her vehicle. She suffered gunshot wounds to both legs and was transported to a local hospital, where she was listed in stable condition.
During the preliminary inves- tigation, police learned that after the deputies were called to the residence, John left the home through the back door, jumped the fence, and walked around to the front of the home.
Theodore heard the fence rattling and went to investigate. At that point, he encountered John, who allegedly had a gun in each hand.
John reportedly told his brother that he was going to kill their mother. While Theodore was holding John in a bear hug, John allegedly shot at their mother several times, striking her once in each leg.
