3.3 การพัฒินาแนวทางการพิจารณาอนุญาตการประกอบธุรกิจของคนต่างด้าว ปี 2567 Developing guidelines for consideration of foreign business applications
เนืองด้้วยลักษณะการประกอบธุุรกิจของค์นต่่างด้้าว ในปัจจุบัน มีการขออนุญาต่ประกอบธุุรกิจประเภทให้ม่ๆ ทีเปลียนแปลงไปต่ามสืภาวการณ์การค์้าการลงทุนระห้ว่าง ประเทศ ห้รือขออนุญาต่ธุุรกิจประเภทเด้ิมแต่่มีร้ปแบบธุุรกิจ ทีห้ลากห้ลายและซับซ้อนมากขึนต่ามค์วามเปลียนแปลงของ สืภาพิแวด้ลอ้ มด้า้ นการค์า้ การลงทนุ ของโลก ซงึ ในการพิจิ ารณา ค์าํา ขออนญุ าต่ประกอบธุรุ กจิ ของค์นต่า่ งด้า้ วของค์ณะกรรมการ การประกอบธุุรกิจของค์นต่่างด้้าว จะต่้องวิเค์ราะห้์เชีิงลึกมาก ขนึ ภายในระยะเวลาทกี ฎห้มายกาํา ห้นด้ ด้งั นนั ค์ณะกรรมการฯ จึงได้้มีการพิัฒนาแนวทางการพิิจารณาอนุญาต่การประกอบ ธุุรกิจของค์นต่่างด้้าวในธุุรกิจให้ม่ๆ ทียังไม่มีแนวทางทีชีัด้เจน ในการพิิจารณาและเป็นธุุรกิจทีนักลงทุนต่่างชีาต่ิสืนใจเข้ามา ประกอบธุุรกิจในประเทศไทยมากขึน ด้ังนี
1) แนวทงกรพิจรณอนุญตธุรกิจที่เก่ียวข้อง กับคร์บอนเครดิต (Carbon Credit)
สืืบเนืองจาก ปี 2566 ค์ณะกรรมการการประกอบ ธุุรกิจของค์นต่่างด้้าว ได้้ให้้ค์วามสืนใจในธุุรกิจทีเกียวข้อง กับการซือขายค์าร์บอนเค์รด้ิต่ซึงประเทศต่่างๆ มีการต่ัง เป้าห้มายในการลด้การปล่อยก๊าซเรือนกระจกเป็นศ้นย์ เพิือ รักษาสืิงแวด้ล้อมอันเป็นสืิงทีทัวโลกต่ระห้นักและให้้ค์วาม สืําาค์ัญ โด้ยธุุรกิจทีเกียวข้องกับการซือขายค์าร์บอนเค์รด้ิต่ เป็นธุุรกิจให้ม่ทีนักลงทุนต่่างชีาต่ิอาจเข้ามาประกอบธุุรกิจใน ประเทศไทยเพิมิ มากขึน โด้ยค์ณะกรรมการฯ ได้จ้ าํา แนกธุรุ กจิ ที เกียวข้องกับการซือขายค์าร์บอนเค์รด้ิต่ (Carbon Credit) อาทิ ธุรุ กจิ ซอื ขายค์ารบ์ อนเค์รด้ต่ิ ธุรุ กจิ ให้บ้ รกิ ารด้า้ นการค์ด้ิ ค์าํา นวณ เรืองค์าร์บอนเค์รด้ิต่ ธุุรกิจให้้ค์ําาปรึกษาแนะนําาวิธุีการค์ําานวณ ค์าร์บอนเค์รด้ิต่ เป็นต่้น
โด้ยในปี 2567 ค์ณะกรรมการฯ ด้าํา เนนิ การศกึ ษาขอ้ มล้ เกียวกับธุุรกิจด้ังกล่าวเพิิมเต่ิม และกําาห้นด้เป็นแนวทางการ พิิจารณาอนุญาต่ให้้มีค์วามชีัด้เจนและสือด้ค์ล้องกับสืภาพิ การณ์ในปัจจุบัน โด้ยกําาห้นด้แนวทางแบ่งเป็น 2 กลุ่ม ด้ังนี
Due to the nature of foreign business operations at present, there is a request for permission to operate a new type of business that has been changed according to the international trade and investment situation, or requesting permission for the same type of business but with a more diverse and complex business-model according to changes in the trade and investment environment of the country. In considering the application for permission to operate a foreign business, the Commission required a more in- depth analysis within the time period specified by law. Therefore, the Commission has developed guidelines for considering permission to operate foreign businesses in the new businesses that do not yet have clear guidelines for consideration and those businesses are increasingly interested in doing business in Thailand as follows:
1) Guidelines for considering permission for businesses related to Carbon Credit
Due to the year 2023, the Commission has taken an interest in the business related to carbon credit trading which various countries aim to reduce greenhouse gas emissions to zero to preserve the environment that the world is aware of and gives importance to. The businesses related to carbon credit trading are new businesses that may increase the number of foreign investors coming to do business in Thailand. The Commission classified the businesses related to carbon credit trading such as carbon credit trading business, carbon credit calculation service business, consulting and recommending methods for calculating carbon credits, etc.
In 2024, the Commission has studied additional information about the said business and set the guidelines for granting permission that are clear and consistent with the current situation. The guidelines are divided into 2 groups as follows:
