2) แนวทงกรพิจรณอนุญตธุรกิจขยอหร และเครื่องด่ืม
ปัจจุบันบริษัทต่่างชีาต่ิเข้ามาประกอบธุุรกิจให้ม่ๆ เพิิมขึน ห้รือมีการปรับร้ปแบบการประกอบธุุรกิจ โด้ยการ ประกอบธุุรกิจอืนๆ เพิือเป็นการสืนับสืนุนธุุรกิจห้ลักของ บรษิ ทั อาทิ ธุรุ กจิ จาํา ห้นา่ ยเฟอรน์ เิ จอร์ ห้รอื เค์รือ งประด้บั เปน็ ธุุรกิจห้ลักและประกอบธุุรกิจการขายอาห้ารและเค์รืองด้ืมเป็น ธุุรกิจสืนับสืนุน เพิือเป็นการอําานวยค์วามสืะด้วกให้้กับล้กค์้า ห้รือพินักงานของต่นเอง ด้ังนัน เพิือให้้การพิิจารณาอนุญาต่ ของค์ณะกรรมการการประกอบธุุรกิจของค์นต่่างด้้าว ให้้มี ค์วามสือด้ค์ล้องกับสืภาพิทางเศรษฐกิจ รวมถึงมีแนวทางการ พิิจารณาทีชีัด้เจนมากขึน จึงได้้ศึกษาข้อม้ลเกียวกับธุุรกิจการ ขายอาห้ารและเค์รืองด้ืม อันเป็นธุุรกิจทีอย่้ในบัญชีีสืาม (19) การขายอาห้ารและเค์รืองด้ืม ในกรณีทีด้ําาเนินธุุรกิจด้ังกล่าว เพิอื สืนบั สืนนุ ธุรุ กจิ ห้ลกั ของบรษิ ทั ห้รอื เพิอื อาํา นวยค์วามสืะด้วก แก่พินักงานของบริษัท โด้ยสืรุปเป็นแนวทางการพิิจารณา อนุญาต่ของค์ณะกรรมการฯ ได้้ ด้ังนี
“การขายอาห้ารและเค์รืองด้ืม” ห้มายถึง การขาย อาห้ารห้รือเค์รืองด้ืมทีประกอบห้รือปรุงจนสืําาเร็จเพิือให้้ผ้้ซือ สืามารถบริโภค์ได้้ทันที ทังนี ไม่ว่าจะจัด้ให้้มีบริเวณไว้สืําาห้รับ การบริโภค์ ณ ทีนันห้รือนําาไปบริโภค์ทีอืนก็ต่าม และให้้ห้มาย รวมถึงการขายอาห้ารทีปรุงสืําาเร็จมาแล้วจัด้ใสื่ถุงห้รือภาชีนะ อืนๆ ทังนี ไม่รวมถึงการขายอาห้ารและเค์รืองด้ืมสืําาเร็จ ห้รือ กึงสืําาเร็จทีผลิต่และบรรจุในห้ีบห้่อสืําาเร็จมาจากผ้้ผลิต่เพิือให้้ ผ้้ซือนําากลับไปบริโภค์
2) Guidelines for considering licenses for business selling food and beverages
Nowadays, foreign companies are increasingly entering into new businesses or the business model has been adjusted by operating other businesses in order to support the main business of the company such as the main business is furniture or jewelry sales and operates the business of selling food and beverages as a supporting business in order to facilitate customers or their own employees. Therefore, the Commission has studied and set the guidelines for considering licenses for the said business that has been consistent with economic condition. This business is in the list 3 (19) of the Act. In the case that such business is carried out to support the main business of the company or to facilitate the company’s employees. In summary, the guidelines for considering permission of the committee are as follows:
“Sale of food and beverages” means the sale of food or beverages that are assembled or prepared so that buyers can consume them immediately. This is regardless of whether an area is provided for consumption there or taken for consumption elsewhere and includes the sale of food that has already been prepared and placed in bags or other containers. This does not include the sale of food and beverages or semi-finished goods that are produced and packed in ready-made packages from the manufacturer for buyers to take back for consumption.
