HIV Confidentiality

Patients/members living with HIV, alcohol, and/or substance
abuse and mental health issues have additional confidentiality
protections by state and federal law

NYS Public Health Law 27-F and Part 63 of the DOH
Regulations:

1. Governs:
a. HIV Testing
b. HIV Confidentiality

c. HIV Reporting and Partner Notification

2. More protective HIV-related information than HIPAA 21

Regulations: Visit Verification

Visit Verification is necessary:

1. To prevent fraud, waste, and abuse
2. To confirm that a service has been provided
3. To ensure the accuracy of our service delivery and billing

Recommendation:
Monthly viewing Visit Location Discrepancy Report (Policy currently being
revised)- look at the team or individual clinician

Please note: Staff are instructed to open their note in the patient’s home
at the start of their visit and have the patient sign the note at the end of
their visit. This is how “visit time in home is calculated.”
