Pre-Employment Testing
All applicants for a driving position shall submit to urine drug tests.
Random Testing
Drug and Alcohol Policy
Foltz Trucking conducts random drug and alcohol testing. Foltz Trucking or its agents shall submit all drivers to a random selection system. The random selection system provides an equal chance for each driver to be selected each time random selection occurs. Random selections shall be reasonable spread throughout the year. Foltz Trucking shall select at a minimum of 25% of driver positions per calendar year for controlled substance testing and 10% of the average number of drivers for the random alcohol testing.
If a driver is selected at random, for either drug or alcohol testing, a Foltz Trucking official shall notify the driver once notified, every action the driver takes shall lead to a collection. If the driver engages in conduct that does not lead to a collection as soon as possible after notification, such conduct may be considered refusal to a test.
Post-accident testing
When an accident involves a human fatality, surviving drivers shall submit to post-accident drug and alcohol testing. When a driver is involved in an accident that requires immediate medical treatment away from the scene or disabling damage to any motor vehicle requiring tow away AND is issued a citation, the driver shall submit to a drug and alcohol test.
The DOT requires that any time a post-accident drug or alcohol test is required, that it be performed as soon as possible following the accident. If no alcohol testing can be obtained within 8 hours, attempts to collect a sample shall cease. IF no urine collection can be obtained, for purposes of post-accident rug testing, within 32 hours, attempts to make such collection shall cease.
Reasonable Suspicion testing
Resonable suspicion for requiring a driver to submit to drug and/or alcohol testing shall be deemed to exist when a driver manifest physical or behavorial sysmptoms or reactions commonly attributed to the use of controlled substances or alcohol. Such driver shall be witnessed by at least one superviosor trained in compliance with CFR 382.601.
PROHIBITED CONDUCT
The following shall be considered "prohibited conduct" for purposes of the policy: No driver shall report for duty or remain on duty while having breath alcohol concentration of 0.04 or greater.
No driver shall be on duty or operate a commercial motor vehicle while the driver possesses alcohol unless the alcohol is manifested and transported as part of a shipment.
