Drug and Alcohol Policy No driver shall use alcohol while performing safety-sensitive functions, including driving, loading, unloading, maintaining or repairing a commercial vehicle, and seeking assistance or remaining in
attendance with a disabled commercial motor vehicle.
No driver required to take a post-accident alcohol test shall use alcohol for eight hours following the accident or until he/she undergoes a post-accident alcohol test, whichever occurs first.
No driver shall refuse to submit to a post-accident, random, a reasonable suspicion, return-to-duty, or a follow-up breath alcohol or urine drug test.
No driver shall report for duty or remain on duty when the driver uses any controlled substance, except when use is pursuant to the instruction of a physician who has advised the driver that the substance does not adversely affect the driver's ability to operate a motor vehicle.
If Foltz Trucking has actual knowledge or had reason to believe the driver has engaged in prohibited conduct, Foltz Trucking may require the driver to submit to drug and/or alcohol testing.
If the driver engages in prohibited conduct, the driver is not qualified to drive a commercial motor vehicleandshallbeimmediatelyremovedfromservice. FoltzTruckingmay,initsdiscretion,atthe request of the driver, keep the driver's position open while such driver attempts to become re-qualified. F & M Transport Inc. may also take action against the employee up to and including termination.
Consequences
A driver who has engaged in prohibited conduct (including accidents and reasonable suspicion determinations) will be immediately removed from performing safety-sensitive functions, including driving. Until a determination has be completed concerning alcohol and/or drug use.
Foltz Trucking will provide to each employee who violates a DOT controlled substance and alcohol regulation a listing of SAP's with names, addresses, and telephone numbers.
It will be the employee's responsibility to obtain a SAP evaluation or any subsequent recommended education or treatment.
Drivers who have successfully complied with SAP's evaluation recommendations may re-apply for a position with Foltz Trucking.
No driver who has engaged in prohibited conduct shall perform safety-sensitive functions for Foltz Trucking including driving a CMV, unless the driver is actively completing the return to duty process or has completed the return to duty process.
