Antitrust Laws and Payer Advocacy

• Antitrust laws promote/protect competition

• Focus: whether an action/market force harms

competition (consumers).

• Key for AGD Advocacy: concerted actions that

unreasonably restrain competition:

• Price Fixing

• Refusal to deal (e.g. boycott/”signal” boycott” insurer)

• Per se violations: If proven, no defense. Can be criminally

prosecuted.
