Returned to you herewith are the documents and material- which you previously provided to this office in connection with our review and possible representation of you in the matter referred to above.
As we discussed, in addition to reviewing all of the material and documents, I have spoken with Attorney David Evans, we have reviewed and considered the Writer's Guild and civil- procedures applicable in this type of case and have analyzed possible legal theories and approaches to the procedural and substantive problems of the case.
As I indicated to you, simply put, it is highly unlikely that a civil courL will disturb the arbitration decision of t.he Writer's Guild. In order to seek such relief, it would be necessary to establish the grounds set forth j-n CCP Section L286.2, such as fraud, failure to foll-ow material- rules and procedures and/or some other gross improprieLy. Absent the above, it appears that you have an insurmountable procedural obstacle, i.e. the arbit.ration decision by the Writer's Guild.
Please be advised, however, that in the event you wish to challenge the Writer's Guil-d determination, an action woul-d need to be filed with the Superior Court within one hundred (1-00) days of the Writer's Guild determination. For other lega1 proceedingis and causes of action, other statutes of limitations would apply. Therefore, if you decide to pursue this matter, Lime is of the essence.
