a. Pedestrians: Pedestrians constitute a large section
of third parties who prefer claims under motor
policies. The pedestrians have not only a right to
use the footpath but also occasionally to use the
road and also cross it.
b. Fare-paying Passengers: These are passengers
who are carried in a public service vehicle. The
owner of a vehicle has a legal duty not only to
provide roadworthy vehicles but also to appoint
competent drivers. The owner's responsibility
commences from the time the passenger enters the
vehicle and continue until he alights there from.
c. Non-fare paying Passengers: The duty of a vehicle
owner towards non-fare paying passengers is to
exercise reasonable skill and care and to provide a
reasonably safe mode of conveyance.
d. Persons in other vehicles: These may be drivers
of other vehicles, the owner of passengers.
e. Children's: Law does not expect a child to exercise
the same care as an adult. Therefore, the driver of
a motor vehicle has to show extra care towards
children on the road.
