polite and spoke on the similar lines and signed whatever letter we asked
him to sign. I was really impressed with their openness and honesty.
While I was returning to the branch, one of our good customers in the
neighborhood of branch premises greeted me and out of courtesy asked
me where I was coming from? I told him, "I had gone to meet the Ford
Truck fleet owner borrower and his guarantor to impress upon
repayment. He knew the borrower and asked me," Were both of them
were very polite, courteous and offered you tea or milk and signed all
your documents and promised to pay the dues by selling their land if need
be?"
I was wonder struck with the exact sequence of events narrated by the
depositor. I asked him how he happened to know these dialogues and
happenings there. He told, "You are the third branch manager who had
been, by chance passing by my house after meeting them. The same
version is repeated every time." I confirmed that it was the same scenario
this time also, and requested him to share what one should do besides
moving to court for attaching assets of guarantor and borrower.
He commented that filing suit might not help now as they are smarter
than the bank. I requested him to elaborate and promised him to keep it
confidential. He disclosed that both of them have filed an application in
the District court for mutual consent decree with their family to transfer
their property in the name of their wives. The decree had already been
granted in favor of their wives. The bank cannot attach the assets of those
who now stand in the name of the third parties and not any more in the
name of borrower and guarantor.
I was tricked!
It was shocking to know that already so much had happened to jeopardize
the interest of the bank and bank officials were unaware. Next day, I met
our bank's senior counsel in the District court and requested to search
