OPTIONAL EXTENSIONS (if stated in the Schedule to be included) Incompa bility cover
Notwithstanding anything contained to the contrary in the Policy, the indemnity by Sub-Sec ons A and B of this Sec on shall indemnify the Insured for costs incurred in respect of:
1. modi ca ons or altera ons to the property insured directly consequent upon indemni able loss or damage to ensure the opera ng integrity of the electronic system;
2. replacement or upgrading of legal programs to achieve compa bility with the modi ed or altered electronic system;
3. the restora on of previously captured data which has become inaccessible due to the modi ca ons to or altera ons of the electronic system or in consequence of the replacement or upgrading of legal programs;
PROVIDED THAT:
1. the costs provided for in 1, 2 and 3 above shall be necessarily and reasonably incurred to maintain normal working condi ons;
2. such addi onal costs shall be incurred as a direct consequence of indemni able loss or damage in terms of Sub- Sec ons A or B (De ned Event 2) of this Sec on;
3. the cover a orded hereunder shall be restricted to:
3.1 parts or components of the electronic system which are not indemni able under Sub-Sec on A hereof;
3.2 programs or data reinstated not indemni able under De ned Event 2 of Sub-Sec on B hereof;
4. the indemnity by this extension shall, in respect of any one event, be limited in the aggregate to 20% (twenty percent) of the applicable total sum insured under Sub-Sec on A (the limit of indemnity) and Sub-Sec on B (De ned Event 2) or R50 000 ( y thousand Rand), whichever is the lesser.
Telecommunica on access lines
Subject to the limits speci ed in the Schedule, consequen al loss as provided for under De ned Events 1 and 2 of Sub- Sec on B arising from accidental failure of the telecommunica on access lines is included;
PROVIDED THAT:
1. the liability of the Company shall not exceed the sum insured by this Sub-Sec on;
2. the indemnity period shall commence 12 (twelve) hours a er the failure and end not later than 30 (thirty) days a er such failure;
3. the insurance provided does not cover loss occasioned by the deliberate act of any telecommunica on authority or by the exercise of such telecommunica on authority of its power to withhold or restrict access to its lines.
Addi onal increased cost of working
The amount stated under Sub-Sec on B – Consequen al Loss De ned Event 1 is increased to the amount stated in the Schedule for which an agreed premium is paid by the Insured.
Addi onal reinstatement of data/programs
The amount stated under Sub-Sec on B – Consequen al Loss De ned Event 2 is increased to the amount stated in the Schedule for which an agreed premium is paid by the Insured.
Riot and strike
Subject otherwise to the Terms, Condi ons, Exclusions, Excep ons and Warran es contained therein, this Sec on is extended to cover damage directly occasioned by or through or in consequence of:
1. civil commo on, labour disturbances, riot, strike or lockout;
2. the act of any lawfully established authority in controlling, preven ng, suppressing or in any other way dealing with any occurrence referred to in 1. above;
