Nevertheless, when the Royal Com-
mission report was finally released on 4 February there was a Mexican wave of sharp inhales and clenched sphincters in insuranceland. The recommenda- tions in this report have huge repercus- sions for the way insurance companies do business. Firstly, it is suggested that the insurance industry be brought in line with the more heavily-regulated fi- nancial services sector. Under Commis- sioner Hayne’s proposals, claims han- dling by insurers would be classed as a “financial service” under the Corpora- tions Act, requiring insurers to handle claims “efficiently, honestly and fairly”.
The current exemption for claims handling limits the extent to which ASIC can intervene, meaning the changes would ramp up the regulation. Changes could include insurance disputes being

overseen by ASIC instead of AFCA, and that the industry codes of practice for both general and life insurance become legally enforceable.
However, many of the changes would depend upon the outcome of a review by the Australian Securities and Invest- ments Commission in 2022, meaning the industry has time to lobby for less ‘dra- conian’ measures.
Of particular note is the Unfair Con- tracts Terms (UCT) which not only ap- plies to the contract with the insured but also to small business contracts. Having asked around, this could mean insurers would be unable to cash settle for an amount that did not reflect the true cost of repair. UCT could also mean the in- surer would no longer have discretion to determine the necessary repairs to be undertaken or the appropriate standard of those repairs.
