Today’s Fire Service Instructor and the Law: Staying off of the Hot Seat

The municipality’s duty to provide adequate training for its employees; it’s one of the most important legal duties. But,
it is often misunderstood and sometimes outright ignored. Problems associated with meeting this duty can contribute
to operational issues with the provision of fire, rescue, and emergency medical services in Iowa, thereby increasing
the possibility of a lawsuit against the municipality, in addition to its leadership and instructors. This session will present
some of the specific training deficiencies and shortcomings that may lead to litigation, including issues associated
with the operation of emergency vehicles and emergency incident responses. In addition, a portion of the session
should address workers’ compensation law regarding firefighters and emergency medical personnel. The course
should also present some legal duties that instructors may not be aware of, including duties for fire departments that
also provide EMS. Along with suggested best practices for instructors and training officers, including guidelines and
training documentation, this session may help you keep off of the hot seat.
